Abstract

Çevreyi korumayı amaçlayan pozitif kurallar, Anayasa, Çevre Kanunu, Medeni Kanun, ilgili yönetmelikler ve Avrupa normunda bulunur.
Türkiye’de doğal kaynakları koruma fikri, 1948 yılında gündeme gelir ve 1956 yılında Orman Kanunu ve Milli “Milli Park” kavramı uygulamaya girer. 1982 Anayasası çevrenin korunması maddesini düzenler (m. 56). Bu madde çevre korumayı, devlet ve vatandaşa ödev olarak verir.
Anayasa çevre koruma maddesi; fiili görev, tartım ölçütü (yararları dengeleme) ve yorum ölçütlerine uygulama sağlar. Çevre İdare Hukukuna, ulusal esaslı hukuk alanları, AB Çevre projeksiyonu ve Çevre İdare Hukuku ilkeleri girer. Bunlar, çevre koruma ve özen gösterme ilkesi,
çevresel zarara sebep olma, kirleten öder ilkesi, çevresel işbirliği ve enformasyon (danışma) ilkeleridir. Ve sürdürülebilir çevre ile temiz bir çevrede yaşama hakkı esastır

The Environment Protection Positive Rules And The Environment Administration Law Principle

Abstract

The positive documents of environment protection are Constitution, environment law, civil code and interested regulations …with Europe Norm.
The protection idea of natural source in Turkey is put on the agenda in 1948.
And the Forest Law an “national park” concept is put into practice in 1956. The article 56 is interested environment protection and be put into effect with
the 1982 Constitution .
The Constitution given together environment protection duty to state and compadriot. The article 56 contains actual duty, scala and interpretation prenciples about environment.
The Environment Administration Law contains the basic rights rules, The EUROPE environment projection and The Environment Administration Law Principles. For example: (1) Protection and prevention principle, (2) Cause prenciple, (3)Kooperation prenciple, (4) Information prenciple.
The sustainable devolopment and environment concepts are very importent for future generations economic and societal needs . For this reason, limited must be used the natural and cultural resources of nature. Everybody must protect to environment. Especially must protect together the state and compadriod.
