Abstract
In this article, the status of the software under the protection of GNU General Public License, which is one of the most widely used Open Source Licenses, within the framework of the Law on Intellectual and Artistic Works and whether the software can be considered as a domestic product according to the Domestic Goods Notification is examined. Within the scope of this study, the current method of calculating the domestic contribution rate of software particularly developed under the GNU General Public License, was also criticized.

Abstract
Bu makalede Açık Kaynak Lisanslarından en yaygın kullanılanlarından biri olan GNU Genel Kamu Lisansı korumasındaki yazılımların, yürürlükteki Fikir ve Sanat Eserleri Kanunu çerçevesindeki durumu ile Yerli Malı Tebliği’ne göre yerli ürün sayılıp sayılmayacağı incelenmiştir. Bu çalışma kapsamında, özellikle GNU Genel Kamu Lisansı altında geliştirilen yazılımların yerli katkı oranının hesaplanmasına ilişkin yürürlükteki yöntemin de bir eleştirisi yapılmıştır.
