İklim ‘Mülteci’lerinin Hukuki Statü Açmazı ve Bu Açmazın Durumlarına Etkileri

Öz

Bu çalışma iklim değişikliğinin etkilerini en erken ve en şiddetli şekilde hisseden/hissedecek kişiler olarak iklim ‘mülteci’lerinin durumlarını daha da zorlaştıran bir faktör olarak kavramsal karmaşa ve hukuki statü eksikliğinin doğurduğu sorunları açmayı amaçlamaktadır. Çalışmamız içerisinde kavramsal karmaşayla, iklim ‘mülteci’lerini karşılamak için literatürde araştırmacıların birbirinden farklı kavramları kullanmalarını ve bunun neticesinde oluşan bir ortak tanım sorununu işaret ediyoruz. Biz bu yönde ‘mülteci’ ifadesini tercih ettik çünkü iklim krizi neticesinde yerlerinden olan/olacak kişiler, her ne kadar uluslararası hukuk anlamında ‘mülteci’ olarak tanımlanmasa da durumlarının aciliyeti ve uluslararası korumaya muhtaç pozisyonlarını vurgulamak bakımından ‘göçmen’ terimi yerini ‘mülteci’ teriminin kullanılmasının daha yerinde olacağını öne sürüyoruz. Hukuki statü eksikliği ise, iklim krizi gibi dünyanın yüzleşmek durumunda kaldığı mevcut en ciddi ve yıkıcı fenomenin etkilerine ilk ve en şiddetli biçimde maruz kalacak kişilerin hukuki statülerini evrensel olarak belirleyen ve ilgili statü gereği uluslararası koruma sağlayan herhangi bir evrensel bağlayıcı metnin bulunmamasını işaret ediyoruz. Nihayetinde böylesi bir hukuki tanım ve korumadan mahrum kalan kişilerin durumunun, önümüzdeki yıllarda iklim değişikliğinin etkilerini daha da hissettirmesiyle birlikte daha da kritik bir hal alacağını iddia ediyor ve bazı çözüm önerilerini çerçeveleyerek çalışmamızı sonlandırıyoruz.

The Legal Status Dilemma of Climate Refugees and the Effects of this Dilemma on their Situation

Abstract

This study aims to address the challenges of conceptual confusion and lack of legal status as a factor that further complicates the situation of climate 'refugees' as those who are/will be feeling the effects of climate change in the most immediate and severe way. By conceptual confusion in our study, we refer to the fact that researchers use different concepts in the literature to refer to climate 'refugees' and the resulting problem of a common definition. We have preferred the term 'refugee' in this direction because, while those who have been/will be displaced as a result of the climate crisis are not defined as 'refugees' in the sense of international law, we argue that the term 'refugee' would be more appropriate than the 'migrant' term in order to emphasize the urgency of their situation and their position of need for international protection. When we refer to the lack of legal status, we point to the absence of any globally binding text that universally defines the legal status of those who will be the first and the most severely exposed to the effects of the current gravest and most catastrophic phenomenon that the world has to face, as the climate crisis, and ensures international protection in accordance with the respective status. Ultimately, we claim that such a situation of people who are deprived of legal definition and protection will become even more critical in the upcoming years as the effects of climate change become much more easily felt, and we conclude our study by framing some suggestions.
