Organized
tawarruq or bank tawarruq (including commodity murabaha, reverse murabaha etc.),
is an application that is widely used in the global Islamic finance market
today and it has been expanding rapidly in Turkish Islamic banking sector as
well during the last decade. Due to its resemblance to profit added cash transaction
from a financial perspective, not containing risk with its fixed return and its
operational convenience, organized tawarruq finds a bigger role for itself in
the sector. Because the fiqh scholars do not approve tawarruq as a main stream
instrument to use, its speed of transmission is reduced and criticism from
academicians that tawarruq is not compatible with Islamic banking principles
and goals causes big discussions. The answer of the bankers to this discussion
is that there is no viable option to organized tawarruq and if there would be
one, they would apply it. Debt restructuring for the customers who can not
continue with the payment installments as planned at the beginning of the
transaction, is one of the main fields that the instrument is widely used in
the sector. The
purpose of this article is to offer an alternative to organized tawarruq used
in debt restructuring through a takaful based solution.
