Amerika Birleşik Devletleri’nde Başkanın Kararname Çıkarma Yetkisi / Executive Order Power of the President in the United States

Abstract

Amaç: Bu çalışmanın amacı, karşılaştırmalı anayasa hukuku verileri ışığında ABD’de başkanın kararname yetkisini ayrıntılarıyla ortaya koymak ve bu analiz ışığında, başkanlık rejimlerinde, başkanın kararname çıkarma yetkisinin anayasal çerçevesini çizmektir. Yöntem: Açıklayıcı araştırma yönteminin kullanıldığı çalışmada, Amerika Birleşik Devletleri’ndeki saf başkanlık rejiminin özellikleri incelenerek, başkanın kararname çıkarma yetkisinin sınırları, derlenen Federal Yüksek Mahkeme’nin verdiği ilke kararlarına göre ortaya konulmuştur. Bulgular: Makalede, Yüksek Mahkeme’nin başkanlık kararnamelerini, anayasal sınır, üst norm değeri, devredilmezlik ilkesi gibi ölçütler kapsamında denetlediğine ilişkin bulgulara varılmıştır. Sonuç: Bu makalede, ABD’de başkanın kararname çıkarma yetkisinin doğrudan Federal Anayasa’da yer almadığı, bu yetkinin anayasal teamüller sonuca ortaya çıkarak, Yüksek Mahkeme içtihatlarına göre şekillendiği sonucuna varılmıştır. ABD’de Başkanın kararname yetkisi yasa gücünde olmayıp, Kongre’nin ilgili kararnameye vereceği destek ise, kararnamelerin düzenlenme ve uygulama alanında son derece etkili olmaktadır. Özgünlük: Çalışmada, ABD Federal Yüksek Mahkemesi’nin, başkanlık kararnameleriyle ilgili günümüz literatüründe yürütülen tartışmalar bakımından öncü nitelik taşıyan ne tür görüşler öne sürdüğünü açıklığa kavuşturmaya yönelik incelemeler yürütülmüştür.

Executive Order Power of the President in the United States

Abstract

Purpose: The aim of this study is to reveal the presidential decree power in the USA in the light of comparative constitutional law data and to draw the constitutional framework of the president's power to issue decrees in presidential regimes in the light of this analysis. Method: In the study, in which the explanatory research method was used, the characteristics of the pure presidential regime in the United States were examined, and the limits of the president's authority to issue decrees were revealed according to the principle decisions given by the compiled Federal Supreme Court. Findings: In the article, it was found that the Supreme Court audited presidential decrees within the scope of criteria such as constitutional limit, upper norm value, and inalienability principle. Implications: In this article, it is concluded that the authority of the president to issue decrees in the USA is not directly included in the Federal Constitution, and this authority is shaped according to the Supreme Court jurisprudence as a result of constitutional conventions. In the USA, the President's decree power does not have the force of law, and the support of the Congress to the relevant decree is extremely effective in the regulation and implementation of the decrees. Originality: In the study, studies were conducted to clarify what kind of views the US Federal Supreme Court put forward in terms of the debates in today's literature on presidential decrees.
