The 2021 Kyrgyz Constitution and the Shift in the Balance of Powers: A Transformation of Legislative-Executive Relations

Abstract

Aim: The aim of this study is to examine the presidential system shaped by the 2021 Constitution of Kyrgyzstan and to evaluate the relationship between the legislative and executive branches within the constitutional framework. The study seeks to analyze the impact of the systemic change on the principle of separation of powers and to reveal how the concentration of power in the executive branch is structured. In this context, the study aims to provide a comprehensive assessment of the general structure of the constitutional system and the functioning of the newly designed government system. Methods: The study employs a descriptive analysis method to examine Kyrgyzstan’s government system within the framework of the 2021 Constitution, focusing on the relationship between the legislative and executive branches. Normative and institutional analyses were conducted through a comprehensive review of constitutional provisions, relevant legal texts, and academic literature. Results: Kyrgyzstan has undergone a profound transformation in its governmental structure by transitioning from a parliamentary system to a presidential system with the adoption of the 2021 Constitution. This systemic change has redefined the relationship between the legislative and executive branches, granting stronger powers to the executive. The evaluations conducted in this study indicate that, although the principle of separation of powers is preserved in theory, in practice the executive holds a dominant position. Within this framework, it can be argued that Kyrgyzstan’s constitutional transformation reflects a delicate balancing act between political stability and institutional equilibrium. Conclusion: The constitutional and legal analysis conducted in this study reveals that Kyrgyzstan transitioned from a parliamentary to a presidential system with the adoption of the 2021 Constitution, which granted extensive powers to the executive branch. Although the relationship between the legislative and executive branches is clearly defined in the constitutional texts, in practice, the executive holds a more dominant influence over the legislature. While the principle of separation of powers is theoretically preserved, the concentration of power in the executive plays a decisive role in the functioning of the system. Furthermore, the systemic change has led to increased centralization in governance and enhanced efficiency in decision-making processes. This development is considered a significant step in Kyrgyzstan’s pursuit of political stability and institutional balance. Originality: This study is one of the few academic works that comprehensively address Kyrgyzstan’s transition to a presidential system under the 2021 Constitution and the legislative-executive relations. While the existing literature generally focuses on broad constitutional changes, this article specifically analyzes the interactions between the legislature and the executive in detail within the context of constitutional texts and institutional structures. Thus, it offers an original contribution by providing a new perspective for understanding the dynamics of Kyrgyzstan’s political system.

2021 Kırgızistan Anayasasıyla Erkler Dengesinde Yön Değişimi: Yasama-Yürütme İlişkilerinin Dönüşümü

Abstract

Amaç: Bu çalışmanın amacı, Kırgızistan’da 2021 Anayasası ile şekillenen başkanlık sistemini incelemek ve bu sistemde yasama ile yürütme organları arasındaki ilişkileri anayasal çerçevede değerlendirmektir. Çalışma, sistem değişikliğinin kuvvetler ayrılığı ilkesine etkisini analiz etmeyi ve yürütmenin güç yoğunlaşması bakımından nasıl yapılandığını ortaya koymayı hedeflemektedir. Bu kapsamda, anayasal sistemin genel yapısı ve dizayn edilen hükümet sisteminin işleyişine dair bütüncül bir değerlendirme sunulması amaçlanmaktadır. Yöntem: İlgili çalışmada, betimsel analiz yöntemi kullanılmış olup, Kırgızistan’ın 2021 Anayasası çerçevesinde hükümet sistemi yasama-yürütme ilişkileri bağlamında incelenmiştir. Anayasal düzenlemeler, ilgili yasal metinler ve akademik literatür taranarak normatif ve kurumsal analiz yapılmıştır. Bulgular: Araştırma kapsamında yapılan anayasal ve yasal incelemeler sonucunda, Kırgızistan’ın 2021 Anayasası ile parlamenter sistemden başkanlık sistemine geçiş yaptığı, bu geçişin yürütme organına geniş yetkiler sağladığı belirlenmiştir. Yasama ve yürütme organları arasındaki ilişkiler anayasal metinlerde açıkça tanımlanmakla birlikte, pratikte yürütmenin yasama üzerinde daha belirleyici bir etkiye sahip olduğu gözlemlenmiştir. Kuvvetler ayrılığı ilkesinin teorik olarak korunmasına rağmen, yürütmenin güç yoğunlaşması sistemin işleyişinde belirleyici rol oynamaktadır. Ayrıca, sistem değişikliğiyle birlikte yönetim yapısında merkeziyetçilik artmış ve karar alma süreçlerinde etkinlik sağlanmıştır. Bu durum, Kırgızistan’ın siyasi yapısında istikrar arayışı ve kurumsal dengeyi sağlama çabaları bağlamında önemli bir gelişme olarak değerlendirilmiştir. Sonuç: Kırgızistan, 2021 Anayasası ile birlikte parlamenter sistemden başkanlık sistemine geçerek hükümet yapısında köklü bir değişikliğe gitmiştir. Bu sistem değişikliği, yasama ve yürütme organları arasındaki ilişkileri yeniden tanımlamış ve yürütme organına daha güçlü yetkiler tanımıştır. Çalışmada yapılan değerlendirmelere göre, kuvvetler ayrılığı ilkesinin teorik düzeyde korunduğu, ancak pratikte yürütmenin belirleyici bir konuma sahip olduğu görülmektedir. Bu çerçevede, Kırgızistan’ın anayasal değişiminin, siyasi istikrar ile kurumsal denge arasında hassas bir denge arayışı içinde şekillendiği söylenebilir. Özgünlük: Bu çalışma, Kırgızistan’ın 2021 Anayasası kapsamında başkanlık sistemine dönüş sürecini ve yasama-yürütme ilişkilerini kapsamlı biçimde ele alan az sayıdaki akademik çalışmadan biridir. Literatürde genellikle genel anayasal değişikliklere odaklanılırken, bu makale özellikle yasama ile yürütme arasındaki etkileşimleri anayasal metinler ve kurumsal yapılar bağlamında detaylı olarak analiz etmektedir. Böylece, Kırgızistan’ın siyasi sistemindeki dinamiklerin kavranmasına yeni bir bakış açısı kazandırması bakımından özgün bir katkı sunmaktadır.
