The administration requires “the personnel” in the execution of its public service activities and ensures the fulfillment of these services through the natural persons it employs. The most important and broad part of the human element of the administration, which could be referred to as public officials in general terms, is the civil servants whose labor force is used in the performance of public service. In the event that a damage occurs due to the acts and actions of civil servants while performing public services, both the administration and the civil servant may be held liable. The administration or third parties could be affected by the damage in question. There are various provisions in the Turkish Constitution and Civil Servants Law in this regard, and the scope and standards of liability vary according to the nature of the defective action of the civil servant. In this study, the financial liability of public officials and civil servants has been considered from various aspects.

İdare, kamu hizmeti faaliyetlerinin yürütülmesinde insan unsuruna ihtiyaç duymakta, istihdam ettiği gerçek kişiler vasıtası ile bu hizmetlerin sunumunu sağlamaktadır. Genel anlamda kamu görevlileri olarak ifade edebileceğimiz idarenin beşeri unsurunun en önemli ve geniş kısmını ise, iş gücünün kamu hizmetine aktarılmasında kullanılan memurluk statüsünde bulunan memurlar oluşturmaktadır. Memurların kamu hizmetlerini yürütürken kusurlu bir biçimde gerçekleştirdikleri eylem ve işlemlerden dolayı bir zararın meydana gelmesi durumunda hem idarenin hem de memurun sorumluluğu hususları gündeme gelmektedir. Memurun kusurlu hareketi neticesinde idarenin ya da idare edilenlerin zarara uğraması mümkündür. Anayasa ve Devlet Memurları Kanunu’nda bu doğrultuda çeşitli düzenlemeler mevcut olup sorumluluğun kapsamı ve sınırları memurun kusurlu davranışının niteliğine göre değişmektedir. Bu çalışmada kamu görevlileri ve memurların mali sorumluluğu çeşitli yönlerden ele alınmaya çalışılmıştır.
