Bu
araştırmayla, 5531 sayılı “Orman Mühendisliği, Orman Endüstri Mühendisliği ve
Ağaç İşleri Endüstri Mühendisliği Hakkında Kanun’a” dayanarak kurulan serbest
The aim of this
study is to determine the legal and administrative problems, and the solution
proposals related “Forest Engineering, Forest Industry Engineering and
Woodworking Industrial Engineering about the Law” law no 5531.
Almost all of the
forests in Turkey are under the state ownership (99.9%). According to the provision “State forests
shall be managed and exploited by the State in accordance with the law” in the
Article 169 of the 1982 Constitution, the management and governance of forests
belong to the State. For this reason, the forestry sector has become a public
sector since almost all activities related to forestry in Turkey are carried
out by the state forestry organization.
Law No. 5531 (also
called as authorization law) is a legal arrangement that enables forest
engineers to carry out professional activities outside the public institution
and constitutes the necessary legal basis for these activities. Forestry
offices which started to be established based on the law no 5531 has played an
important role in carrying out a large number of activities related to
forestry.
Law No. 5531
entered into force in 2006 is a fairly new law. Therefore, it is known that
there are some problems in practice, and provisions that are need to be
amendment. For this purpose, an original questionnaire was prepared for the
members of the TMMOB Chamber of Forest Engineers, and were asked to complete the questionnaires
through telephone, e-mail, etc. Finally, a total of 63 people were surveyed and
the results were interpreted with frequency values and percentages.
While analyzing
the answers to the questionnaires, frequency values and percentages were
interpreted for the purpose of the research. According to the data obtained;
free forestry offices show a profile as are mostly men, aged between 25-35
years, graduated with the undergraduate degree, operating for nearly 10 years,
graduated between 2006 and 2016, established in the locations of the Regional
Directorates of Forestry in the province of Istanbul, graduated from the
Faculty of Forestry of Istanbul University, with a monthly average income of TL
5.000-10.000.
On the other hand,
the problems that forestry bureau owners mostly faced and listed are
bureaucracy density which prevents the works to be carried out more quickly and
practically; the lack of education in the faculties related to the fields of
activity of the free forestry offices, the lack of practical support in theory
and the inadequate implementation; the excessive price breakdown of the
forestry offices and the necessity of the completion certificate etc.
Suggestions for
solutions; merit should be given more importance in appointments, reducing the
intensity of bureaucracy; uniform files should be requested; communication
needs to be more warmer and more intimate, and private forestry practices
should be used more intensively in the sector. The solution to problems
encountered for the legislation and the Chamber of Engineers are; there is a
need to be strictly inspected files without complaint; unfair competition
should not be tolerated; make the processes objective away from politicization
and to pay attention to the minimum unit prices of the Chamber of Engineers.
In order to solve
these problems, it was found that there is a need to meet in a
solution-oriented common ground that will be developed by the representatives
of TMMOB Chamber of Forest Engineers, faculties of related universities, state
forest organization and related non-governmental organizations.
