Explanation Of Some Principles And Provisions Of Criminal Law And Administrative Law With The General Bases Of Mecelle
Abstract
One of the periods of Islamic law is codification period. Mecelle is one of the codes which was legislated in this period. Mecelle was legislated by a commission whose president was Ahmet Cevdet Pasha. Mecelle is a code which was prepared between the years 1868-1876. Mecelle was prepared based on Islamis law rules; but there is only precedents of the Hanafi sect within it. It can be said that Mecelle is a civil code; but there are no provisions concerning family law and inheritance law within it. In Mecelle, there are 16 books with an introduction. According to system of Mecelle, these books are divided into parts, parts divided into chapters. In Mecelle, there are 1851 articles. Mecelle was legislated with event-based method which is one of the legislating method. In the introduction part of Mecelle, there are two paragraphs. The first article of Mecelle is the first paragrafh. In first paragraph, description and scope of the Islamic law are explained. Between the second and the hundredth article of Mecelle, there are principles which are named as general bases. These principles are abstract principles that can be applied to every events. In other saying, these principles are abstract principles that can be applied in all disciplines of the law. In this context, in this work, the problem of applicability of the general bases of Mecelle in the field of public law will be examined.
