Abstract

İslam hukuku ve siyaset arasındaki etkileşim, İslam medeniyet tarihi boyunca belli ölçüde kendini hep hissettirmiştir. Dönemin siyasal anlayışına ve İslam hukukçularının konumuna bağlı olarak bu etkileşim bazen zayıf, bazen de güçlü bir şekilde vuku bulmuştur. Bu duruma birçok dönem örnek olarak zikredilebilir mahiyettedir. Ancak en bariz dönemlerden biri şüphesiz Memlükler devleti dönemidir. Memlükler dönemi uzun, hareketli ve çok dinamik bir dönem olması hasebiyle dikkat çekmiştir. Nitekim Memlükler, İslam dünyasını Moğol ve Haçlı seferlerine karşı dış cephede korurken, iç cephede de dinin ve siyasal otoritenin bir dengede tutulmasına özen göstermişlerdir. Dolayısıyla böyle aktif ve dinamik süreçler İslam hukuku, İslam tarihi vb. sahalarda özgün çalışma alanları sunmaktadır. İşte, Dr. Mehmet Aziz Yaşar’ın kaleme aldığı ve Doç. Dr. Veysi Ünverdi ile Doç. Dr. Selim Aslan’ın editörlüğünü yaptığı ‘‘Memlükler döneminde fıkıh-siyaset ilişkisi’’ adlı eser sözü edilen bu çalışmalardan bir tanesidir. Bu eser yaklaşık iki buçuk asır hüküm sürmüş (1250-1517) Memlükler’deki bu hareketli ve karmaşık durumu fıkıh-siyaset ilişkisi ekseninde ele almaktadır.

The Relationship Between Fiqh and Politics in the Mamluk Period

Abstract

The interaction between Islamic law and politics has been evident throughout the history of Islamic civilization. It has always made itself felt to some extent. The political understanding of the period and the views of Islamic jurists depending on the position, this interaction sometimes occurred weakly and sometimes strongly. Many periods can be cited as examples of this situation. But one of the most obvious the periods is undoubtedly the Mamluk state period. The Mamluk period was long, eventful and attracted attention because it was a very dynamic period. As a matter of fact, the Mamluks, Islam while protecting the world against the Mongol and Crusader invasions on the external front, they also took care to keep religion and political authority in balance on the internal front. Therefore, such an active and dynamic processes Islamic law, Islamic history, etc. It offers original working areas in fields. Here, written by Dr Mehmet Aziz Yaşar and Assoc. Dr. Veysi Ünverdi and Assoc. Dr. Selim Aslan's work titled "The relationship between fiqh and politics during the Mamluk period" This is one of the studies conducted. This work ruled for approximately two and a half centuries (1250- 1517) and discusses this active and complex situation in the Mamluks in the axis of the relationship between fiqh and politics.
