Penalty of Deprivation of Rights on the Axis of Islamic Law and Modern Law

Abstract

This study deals with the deprivation of rights penalty, which can be an alternative to sanctions that restrict freedom and is encountered in different forms in almost every legal system. It is seen that the studies conducted on the deprivation of rights penalty in the field of Islamic law are limited to certain crimes in a narrower framework. In the article, the subject is addressed more comprehensively in terms of Islamic criminal law in general, is examined comparatively with the contemporary understanding of law, and the possibility of it being a foreseeable, alternative sanction for various crimes today is discussed. The fact that there are many examples on the subject in the Quran, which is the first and fundamental source of Islamic law, and also that the deprivation of rights penalty is prescribed for various crimes in Islamic criminal law, reveals the importance of the subject. When considered in terms of its impact on many legal systems throughout history, it is anticipated that addressing and examining the subject in terms of Islamic law in general will contribute to the field. In addition, it is assumed that deprivation of rights, which takes place under different names and forms in today’s legal legislation, can be an important alternative to punishments that restrict freedom.
