Birleştirici İnsan Onuru Anlayışı

Abstract

Öz: İnsan onuru kavramı, ahlaki, hukuki ve siyasi söylemlerin kaçınılmaz temalarından biridir ve insanın değerine ve statüsüne yönelik temel bir taahhüdü temsil eder. Anlamlarını kullanıldıkları kozmolojik, antropolojik veya siyasi bağlamdan alan, birbiriyle çelişen birçok insan onuru anlayışı vardır. İnsan onuru, insan türünün sahip olduğu özel üstünlüğü, akıl sahibi insanlıkla bağlantılı özel potansiyeli ya da her bireyin temel haklarını ifade edebilir. Dolayısıyla, kavramın yerleştirilebileceği, çarpıcı biçimde farklı normatif kullanımlar vardır. İnsan onuru, kutsallık, özerklik, kişilik, gelişme ve özsaygı gibi kavramlarla çeşitli şekillerde bağlantılıdır ve farklı zamanlarda hem katı yasakları hem de bireyin yetkilendirilmesini içerir. İnsan onuruna ilişkin felsefi bir çözümleme, ahlak, siyaset ve hukuk felsefesindeki geniş kapsamlı tartışmalara bakılarak yapılabilir. İnsan onuruna ilişkin, kısmen ya da tamamen birbirinden farklı, ödev etiğine dayalı iki anlayış bulunmaktadır. Bunlardan biri erdem temelli yükümlülükleri, diğeri ise adalet temelli hakları ve ilkeleri ima etmektedir. Her ne kadar hukuk, ahlak ve siyasetin farklı pratikleri ve felsefi önkabulleri nedeniyle insan onuruna ilişkin farklı anlayışları ortak bir noktada buluşturmak zor olsa da birleştirici bir insan onuru anlayışı imkânsız değildir. Hatta bu anlayış, insan onuru kavramının başka anlaşılma ve kullanılma biçimlerini değerlendirmek için de kaçınılmazdır. Bu makale, çeşitli tartışmalar bağlamında insanın statüsüne ilişkin bir iddia ve çağdaş uluslararası hukuk ve insan hakları tartışmalarının doğal bir bileşeni olarak insan onurunun ahlaki, hukuki ve siyasi uygulamaları birleştirmeyi amaçlayan birleştirici bir anlayış olduğuna açıklık getirmeyi amaçlamaktadır. An Interstitial Concept of Human Dignity

Abstract

Abstract: The concept of human dignity is one of the inevitable themes of moral, legal, and political discourse and represents a fundamental commitment to the value and status of the human person. There are many conflicting understandings of human dignity, each deriving its meaning from the cosmological, anthropological, or political context in which it is used. Human dignity can refer to the unique superiority of the human species, the special potential associated with rational humanity, or the fundamental rights of every individual. Consequently, there are strikingly different normative uses to which the concept can be applied. Human dignity is linked in various ways to concepts such as sanctity, autonomy, personhood, development, and self-respect, and at different times has encompassed both strict prohibitions and the empowerment of the individual. A philosophical analysis of human dignity can be conducted by examining the broad-ranging debates in the philosophy of ethics, politics, and law. There are two understandings of human dignity—based on duty ethics—that are partially or entirely distinct from one another. One implies virtue-based obligations, while the other implies justice-based rights and principles. Although it is difficult to reconcile these differing understandings of human dignity into a common ground due to the distinct practices and philosophical presuppositions of law, ethics, and politics, a unifying conception of human dignity is not impossible. Indeed, such a conception is indispensable for evaluating other ways in which the concept of human dignity is understood and applied. This article aims to clarify that human dignity constitutes a unifying understanding—one that seeks to integrate its moral, legal, and political applications—as a claim regarding the status of the human being within various debates and as a natural component of contemporary international law and human rights discourse.
