Abstract

Dünyada maden hukukunda yaşanan gelişmelerde madenlerin devlet eliyle işletilmesi ile özel

sektör madenciliğinin özendirilmesi anlayışı etken olmuştur. Buna ilaveten çevre hukukunun

baskısıyla gelişen sürdürülebilir kalkınma kavramının da maden hukuku reformlarında etkisi

yadsınamaz. Şili’den başlayarak Meksika ve Peru’da yapılan maden hukuku reformları Güney

Amerika Kanun Modeli olarak dünyaya örnek gösterilmiştir.

Dünya Bankası ve diğer uluslararası kuruluşlar birtakım inisiyatifler hazırlayarak tekdüze bir

maden kanunu oluşturarak ortak bir maden kanunu “lex minarele” oluşturma çabaları sürmektedir.

Ancak ülkelerin madencilik sektöründen beklentileri, çevreciler ve diğer baskı grupları maden

hukuku mevzuatının oluşumunda ve değiştirilmesinde önemli rol oynamaktadırlar. Maden

hukuku mevzuatında yapılan değişiklik ve yenilikler, Mevzuat Etki Değerlendirilmesi adı altında

ölçümlemeye ve analiz edilmeye tabi tutulmaktadır. Çalışmamızda maden hukuku reformu olarak

dikkate değer değişiklikler yapan ülke kanunlarıyla ilgili genel bir değerlendirmeye yer verilmiştir.
