Abstract
Dünyada özellikle İkinci Dünya Savaşı sonrasında kamu yönetimi ve insan hakları alanında zihniyet değişimi yaşanmış, geleneksel denetim araçlarının kamu yönetimlerini denetlemede yetersiz kalması nedeniyle, İsveç modeli çerçevesinde ombudsmanlık giderek yaygınlaşmıştır. Türkiye de değişim ve gelişime uymakta geç kalmış, 2006 yılında çıkarılan kanun Anayasa Mahkemesi’nce iptal edilince 2010 yılında anayasa değişikliği yapılarak bu kurum kamu denetçiliği adıyla anayasaya girmiştir. Ülkemizde kamu denetçiliği (ombudsman) kurumuna yönelik arayışlar yasal olarak kamu denetçiliği kurumunun oluşturulmasıyla sonuçlanmıştır. Çalışmada kamu denetçiliği kavramı, kamu denetçiliği kurumunun tarihsel gelişimi ve özellikleri incelenmiş ve kamu denetçiliği kurumuna ülkemizde hukukilik kazandıran 6328 sayılı Kamu Denetçiliği Kurumu Kanunu değerlendirilmiştir.
Abstract
The aim of this study is to examine the public inspectorship in Turkey through the establishment, historical development and general characteristics of the Public Inspectorship Institution, and the Public Inspectorship Institution Act 6328. Swedish public inspection model has been adopted and implemented by many countries since the traditional public inspection means have been insufficient to control public administrations and because of the improvements in state of law and human rights in the world. Legislation studies in this field have been initiated in Turkey with the act 5548 enacted in 2006. A constitutional change has been realized with a plebiscite conducted in 2010 because the act was revoked by the Constitutional Court. The Public Inspectorship Institution has been established with the act 6328 in 2012 after the constitutional restraint was eliminated. In the Act, inspection scope of the institution has been limited to the fields other than legislation, jurisdiction and military transactions.
