While Turkey has carried out major constitutional and legal reforms , she continually delayed "supranationalite", a major quality of EU law. Unlike international law which is built upon the principle of equality of state sovereignty, supranational law is built upon the transfer ofa part ofa state's sovereignty. Although it does not appear on any of the EU legal documents, supranationality of the EU legal system is stressed openly in many o f the decisions o f the Community's Justice Council. Acting with this in mind, the governments of the old and new members have accepted the turnover of a part of their sovereignty to international or supranational organizations by amending their constitutions. In parallel to this, these states have also amended their constitutions in the area ofdomestic versus international law to give supremacy to international law.
This study brings a new outlook to our main theme of "European Union's Enlargement Perspective and Turkey" in the area of partial surrendering of its sovereignty and supremacy of EC law, which is as important as any other reform Turkey has had to carry out in its bid to join the EU. On the other hand, since the main theme is not "Turkey in the Enlargement of the European Union" but the "European Union's Enlargement Perspective and Turkey", this study will analyze not only Turkey but will seek to comparatively look at all new member countries.

AB hukuk belgelerinin hi(:bir yerinde yer almamakla birlikte AB'nin uluslariistii hukuk sistemine sahip oldugu, Topluluk Adalet Divam 'mn bir (:Ok kararmda apk(:a vurgulanmakta. j~te bu bilin(:le hareket eden tiim iiye devletler ve aday iilkeler, anayasalarma koyduklan hiikiimlerle egemenlik yetkilerinin bir boliimiinii uluslararasz ya da iistii kurulu~lara devredebileceklerini kabul etmi~ler. Bu diizenlemeye paralel olarak soz konusu devletler, i(: hukuk-uluslararasz hukuk (:atz~masz halinde, devletlerin uluslararasz sorumlulugunun dogmamasz amaczyla AT hukuku da dahil uluslararasz hukuka oncelik tamyan hiikiimleri de anayasalarma koymu#ar. Bu (:ail~ma, Tiirkiye'nin tam iiyelik yolunda yapmasz gereken, belki de en az bugiine degin yaptzgz diizenlemeler kadar onemli olan egemenlik yetkilerinin kullammmm devri ve AT hukukunun onceligi konularma, falz~marruzzn ana temasz olan "AB'nin Geni#eme Perspektifi ve Tiirkiye" r,;err,;evesinde yeni bir bakz~ ar,;zsz getiriyor.
