Özet
Çağda~ İslam dü~üncesinin en önemli figürlerinden olan Rqid Rıza'nın ıslah dü~üncesinin fıkıh
ilmine nasıl yansıdığının inedendiği hu çalı~rnada konu, dört alt ba~lık dahilinde ele alınmı~tır. İlk
olarak müellifin klasik fıkıh usulüne yiindttiği dqtirilere değinilmi~. ardından, fıkıh sahasında
teklif edilen fikirler "modern fıkıh dü~iincesi" kavramsalla~tırması altında incdcnrni~tir. Burada
önce rnüellifin modern fıkıh dü~üncesinin tarihlisosyolojik zeminini olu§turan değerlendirmeleri
ele alınrnı~tır. İctihad, taklid ve mezhep kavrarnlarının bütünüyle modern bir içerikle ve fıkıh dı~ı
bir alanla irtibatlı <'larak takdim edildiği bu kısmın ardından, mc,dern fıkıh dü§üncesinin felsefi
zeminini olu§turan fıkıh, tahiat ve ~eriat kavramlarıyla ilgili değerlendirmelerine temas edilmi§;
son olarak müellifin bu dü~üncesinin hukuk! zeminine değinilmi§tir. Burada klasik fıkıh anlayı§ının
usul ve füruuna alternatif olacak değerlendirmelerin temelini te§ kil eden "yeni ilkeleri (ııstıl)"
ve bu ilkelerin fıkıh alıkamma yansımasıyla ilgili rnüellifin dü§ünceleri ele alınmı§tır

Abstract
Separated into four titles, this paper is an inquiry into the manner in which the idea of islah as
propounded by Rashid Rida, one of the most promincnt figures of contemporary lslamic thought,
is transposed into the science of fiqh. This study first touches on the critique which this scholar
raised against the rnethcıds of the dassic fıqh and then presents his ideas in the area of fiqh which
are analysed under the concept of "the idea cıf mcıdern fiqh". The author's ideas that constitute
the historical/sociological background of his cemception of modern fiqh are evaluated in this cemtext.
Having presented the concepts of ijtihad {creative interpretation of Islamic law), taqlid (irnitation)
and madhhab (school of lslamic law) in a wholly modern context and in connection with
a non-fiqh area, the paper proceeds with an assessment of his idea of fiqh, nature and sharia that
fonn the philosophical bases of the idea of modern fiqh. This study finally acidresses the legal
roots of Rashid Rida's idea of law. In this paper, his "new principles (usul)" that constittıte an
altcrnative to the rnethodolor,'Y and practiccs assodared with classical unders tanding of fiqh and
his ideas regarding the way in which thcse principles should be carried into the lslamic substantive
law are scrutinizcd.
