DEVLET DIŞI AKTÖRLERE KARŞI YASAL SAVUNMA HAKKI KULLANILMASI

Abstract

Uluslararası Hukuk sisteminde ortaya çıkan değişim terörizmle

mücadele bağlamında BM Şartı’nın VII. bölümüne ve yasal savunma

hakkına istinat edilmesi tartışmasını gündeme getirmiştir. Uluslararası

Hukukta görülen değişim her şeyden önce devlet ve devlet dışı aktörlerin

ilişkisi ve devletlerin Uluslararası Hukuktaki statüsü bağlamında ortaya

çıkmaktadır.

Makalede devlet odaklı sistemden çok kutuplu sisteme geçiş, yasal

savunma hakkı ve kuvvet kullanma yasağı ilişkisi, Uluslararası Adalet

Divanı’nın konuya ilişkin yaklaşımı, terör eylemlerinin niteliği yeni

gelişmeler ışığında ele alınmaktadır.
