Abstract

Yıkıcı teknolojilerin hayatın her alanına olduğu gibi bedensel zararlara
da hem olumlu hem olumsuz etkileri bulunmaktadır. Bunların salt
olumsuz etkilerine odaklanmak yerine olumlu etkilerinden faydalanmak,
olumsuz etkilerinin farkında olmak ve teknolojiyi doğru yönetmek
gerekmektedir. Teknolojiden doğru bir şekilde faydalanmaya yönelik
akıllı toplum felsefesi olan Toplum 5.0’ın da odaklandığı nokta budur.
Hukukun buradaki işlevi teknolojik ürünlerin üretim ve kullanım kuralları
bakımından düzenleyici ve bunların kullanılması nedeniyle oluşan
zararların giderilmesi bakımından etkin ve caydırıcı olmaktır. Bunun
için de hukukçular ve kanun koyucu tarafından teknolojinin ve olumlu
ve olumsuz etkilerinin yakın olarak takip edilmesi gerekmektedir. Ayrıca
toplumun teknolojik gelişmelere adapte olurken küçük yaşlardan itibaren
teknolojinin doğru kullanımı hakkında bilgilendirilmesi gerekmektedir.
