ÇOCUK İSTİSMARI’NIN AĞIR BİR TÜRÜ: BAKIM VERENİN YAPAY BOZUKLUĞU’NA (Munchausen By Proxy Sendromu) HUKUKİ VE TIBBİ BAKIŞ

Abstract

Munchausen By Proxy Sendromu (Bakım Verenin Yapay Bozukluğu ya
da Vekaleten Hastalık Oluşturma); çocuk istismarının bir türüdür. Bu istismar
türünde bakım veren çocukta fiziksel ya da psikolojik semptom ve
hastalık belirtileri oluşturarak çocuğu hastane hastane dolaştırmakta ve
çocuk bu süreçte mağdur edilmektedir. Hem sağlık hem hukuk alanında
karşılaşılan ve çok da nadir olmayan bu durumda vaka uygun yönetilemediğinde
bu sendromun çocukta kısa ve uzun vadeli olumsuz etkileri
oluşmakta, bu etkiler ciddi yaralanmalara kimi zaman da ölüme neden
olabilmektedir. Bu nedenle bu sendromun sağlık ve hukuk alanında tanınması
ve anlaşılmasının sağlanması önemlidir.
Makalemizde bu sendromun tıbbi değerlendirme kısmında tanımı yapılmış,
klinikte karşılaşılan farklı durumlarla kompleks vaka yönetimi aydınlatılmaya
çalışılmış olup; hukuki değerlendirmede de biri ulusal diğeri uluslar arası boyutta iki dava üzerinden hukuk alanındaki eksikliklerin altı çizilerek ve standart bir hukuki yaklaşım olamayacağı vurgulanarak, vaka özelinde multidisipliner yaklaşımın gereğine dikkat çekilmesi amaçlanmıştır.
