Ukrayna Savaşının Uluslararası Hukuk Işığında Değerlendirilmesi

Öz

24 Şubat 2022’de başlayan Rusya-Ukrayna savaşı günümüzde halâ tam hızıyla devam etmektedir. Makalede uluslararası barışı ve güvenliği bozan ve tehdit eden bir konu olarak Rusya-Ukrayna savaşı uluslararası hukuk ışığında değerlendirilmiştir. Konu özellikle BM kurumsal yapısında, BM Güvenlik Konseyi’nde, BM Genel Kurulu’nda, Uluslararası Adalet Divanı’nda Avrupa Konseyi’nde ve AB’de ele alınışı itibarı ile değerlendirilmiş ve tarafsızlık hukuku ve uluslararası ceza hukuku ışığında yorumlanmıştır. Bu bağlamda makalede Ukrayna’ya yapılan silah desteğinin ve Rusya’ya uygulanan yaptırımların dayanağı olarak kabul edilen BM Kurul rezolüsyonu ışığında tarafsızlık hukukunda saldırı suçu ile bağlantılı olarak ortaya çıkan yeni gelişmelere yer verilmiş ve konu son olarak Devletlerin Uluslararası Sorumluluğu Anlaşma tasarısı hükümleri muvacehesinde ele alınmıştır.

Evaluation of the Ukrainian War in the Light of International Law

Öz

The Russia-Ukraine war, which started on February 24, 2022, is still continuing at full speed today. In the article, the Russia-Ukraine war, as an issue that disrupts and threatens international peace and security, is evaluated in the light of international law. The issue has been evaluated especially in terms of its handling in the UN institutional structure, the UN Security Council, the UN General Assembly, the International Court of Justice, the European Council and the EU, and interpreted in the light of neutrality law and international criminal law. In this context, in the article, new developments in the law of neutrality in connection with the crime of aggression are included in the light of the UN Assembly resolution, which is accepted as the basis of the support provided to Ukraine and the sanctions imposed on Russia, and the issue is finally discussed in accordance with the draft provisions of the Agreement on the International Responsibility of States.
