Constructing Colonial Justice: British Legal Reforms in Cyprus, 1878-1914

Abstract

This article examines the British legal reforms implemented in Cyprus between 1878 and 1914, analysing the sources and impacts of these reforms. Although Cyprus has been recognised as a strategic dominion of British imperial system, the relationship between legal reform and colonial legitimacy was yet to sufficiently examined. Drawing on archival documents; including colonial statutes, court records, Cyprus Blue Books, and contemporary administrative reports, this study analyses the reconstruction of court system, the appointment of judicial personnel, and the enactment of new ordinances. Using a historical and analytical approach, this article evaluates how British authorities reorganised the court system while preserving selective elements from Ottoman legal codes, Islamic law, Orthodox ecclesiastical tribunals, and customary legal practices. The findings demonstrate that British legal reforms did not reshape the entire existing Ottoman legal system, but rather produced a plural legal order in which multiple legal systems coexisted under colonial supervision. This legal pluralism functioned as a strategic tool enabling British authorities to consolidate administrative control, institutionalise imperial authority, and legitimise colonial governance. By situating Cyprus within broader debates on colonial legal systems, this study contributes to the historiography of colonial law and highlights legal pluralism as an instrument of imperial rule.
