Abstract

Ömer Korkmaz, in his study titled The Distinction between Worship and Treatment in Islamic Jurisprudence, deals with the distinction between worship and treatment, which has an important place in Islamic law, together with its discussions in classical and modern periods. This study, which was written as a master's thesis and later published as a book, examines this distinction, which has not been discussed under a separate title despite being discussed intensively in the post-Tanzimat period, in a systematic framework and makes an important contribution to the literature. The work consists of three main chapters, including an introduction and a conclusion. In the first part, the scope and history of fiqh and the basic features of the distinction between worship and practice are discussed, while in the second part, this distinction is discussed within the framework of concepts such as ta'līlizability, maslahat and custom in classical usul al-fiqh. In the third part, the debates in the modern period are evaluated through the approaches of names such as Rashid Riza, Ziya Gökalp and Fazlurrahman.

İslam Fıkhında İbadet Muamelat Ayrımı

Abstract

Ömer Korkmaz, İslam Fıkhında İbadet-Muamelat Ayrımı adlı çalışmasıyla, İslam hukukunda önemli bir yer tutan ibadet ve muamelat ayrımını klasik ve modern dönemlerdeki tartışmalarıyla birlikte ele almaktadır. Yüksek lisans tezi olarak kaleme alınan ve daha sonra kitaplaştırılan bu çalışma, Tanzimat sonrası dönemde yoğun bir şekilde tartışılmasına rağmen müstakil bir başlık altında ele alınmayan bu ayrımı sistematik bir çerçevede incelemekte ve literatüre önemli bir katkı sunmaktadır. Eser, giriş ve sonuç bölümleriyle birlikte üç ana bölümden oluşmaktadır. İlk bölümde fıkhın kapsamı, tarihçesi ve ibadet-muamelat ayrımının temel özellikleri ele alınırken ikinci bölümde klasik fıkıh usulünde bu ayrım ta’lîl edilebilirlik, maslahat ve örf gibi kavramlar çerçevesinde tartışılmıştır. Üçüncü bölümde ise modern dönemdeki tartışmalar Reşid Rıza, Ziya Gökalp ve Fazlurrahman gibi isimlerin yaklaşımları üzerinden değerlendirilmiştir.
