In Article 19 of the Condominium Law, the property owners are obliged to take care of the main immovable and to meticulously protect its architectural condition, beauty and durableness. In this context, property owners are under the obligation to preserve the architectural condition of the main immovable. As a result of this, no innovations, changes or modifications can be made on the main immovable property that contradicts to the architectural project. In the event that a building contrary to the architectural project is built in an immovable subject to condominium ownership, the flat owner/owners may apply to the court and request the judge to intervene. If the court finds upon request that there is a constructions contrary to the architectural project in its examination, court should decide that new constructions should be removed and made suitable for the architectural project. However, if the elimination of the part of construction that contradicts to the architectural project will disrupt the static structure of the main immovable, the case should be rejected due to the lack of legal benefit. In addition, a claim for compensation can be made against the flat owner who violates his obligations. If the conditions exist, the court should also award compensation.

Kat Mülkiyeti Kanununun 19 uncu maddesinde kat maliklerine ana taşınmazın mimari durumunu koruma yükümlülüğü yüklenmektedir. Kat mülkiyetine konu olan bir taşınmazda mimari projeye aykırı yapı yapılması halinde kat maliki/malikleri mahkemeye başvurarak hâkimin müdahalede bulunmasını isteyebilir. Mahkeme istem üzerine yapacağı incelemede mimari projeye aykırı yapının varlığına kanaat getirirse, bu yapının ortadan kaldırılarak mimari projeye uygun hale getirilmesine karar vermelidir. Ayrıca yükümlülüğüne aykırı davranan kat maliki aleyhine tazminat talebinde de bulunulabilir. Şartlarının mevcut olması halinde mahkeme tazminata da hükmetmelidir.
