THE LEGAL REALISM OF KAFKA’S THE TRIAL: REFLECTIONS ON THE IMPOSSIBILITY OF THE RULE OF LAW AND THE TOTAL JURIDIFICATION OF LIFE

Abstract

This study’s main objective is to argue that Kafka, in The Trial, does not merely stage an irrational situation in which the supremacy of law appears illusory, revealed through a juridical labyrinth. Instead, the study aims to show that Kafka ideologically creates the impossibility of the liberal Rechtsstaat within an ambiguated and irrational judicial space. This means that The Trial is not an absurd account or mise-en-scène of an unlawful legal process that befalls an ordinary individual/citizen; in an ontological sense, it is a novel of material lawlessness in which the impossibility of what we call the rule of law, or the Rechtsstaat, is fictionally produced. Based on this claim, the study aims to argue that two simple factors enable The Trial to accomplish this creation: (1) the fictional fact that all events in the novel unfold entirely within a condition/state of peace, rather than in a state of emergency or a state of war; (2) the foregrounding of the ideological dimension of law -not only in terms of its masking or mystifying functions, but (re)structuring and reproducing affection of the social reality.
