THE LEGAL REALISM OF KAFKA’S THE TRIAL: REFLECTIONS ON THE IMPOSSIBILITY OF THE RULE OF LAW AND THE TOTAL JURIDIFICATION OF LIFE

Abstract

This study’s main objective is to argue that Kafka, in The Trial, does not merely stage an irrational situation in which the supremacy of law appears illusory, revealed through a juridical labyrinth. Instead, the study aims to show that Kafka ideologically creates the impossibility of the liberal Rechtsstaat within an ambiguated and irrational judicial space. This means that The Trial is not an absurd account or mise-en-scène of an unlawful legal process that befalls an ordinary individual/citizen; in an ontological sense, it is a novel of material lawlessness in which the impossibility of what we call the rule of law, or the Rechtsstaat, is fictionally produced. Based on this claim, the study aims to argue that two simple factors enable The Trial to accomplish this creation: (1) the fictional fact that all events in the novel unfold entirely within a condition/state of peace, rather than in a state of emergency or a state of war; (2) the foregrounding of the ideological dimension of law -not only in terms of its masking or mystifying functions, but (re)structuring and reproducing affection of the social reality.

Kafka’nın Dava’sının Hukuki Realizmi: Hukuk Devletinin İmkansızlığı ve Yaşamın Topyekun Hukukileştirilmesi Üzerine Düşünceler

Abstract

Bu çalışmanın temel amacı, Franz Kafka’nın Dava’da, yalnızca hukukun egemenliğine ilişkin irrasyonel bir yanılsama durumunu sahnelemediğini ileri sürmektedir. Sahnelenen, hukukun egemenliğinin, bir tür muğlak ve irrasyonel yargı labirenti içinde ortaya çıkan bir yanılsama olarak belirmesi değildir. Makale, daha ziyade, Kafka’nın liberal hukuk devletinin imkânsızlığını, muğlaklaştırılmış ve irrasyonelleştirilmiş görünen bir yargı mekânı içinde ve ideolojik düzeyde, edebi olarak yarattığını ileri sürmektedir. Bu bağlamda Dava, sıradan bireyin/yurttaşın başına gelen hukuksuz bir yargılama sürecinin absürt bir anlatısı ya da mizanseni değildir; ontolojik anlamda, hukukun üstünlüğü ya da hukuk devleti olarak adlandırılan idealin imkânsızlığının edebi düzlemde kurulduğu bir maddi hukuksuzluk romanıdır. Bu temel iddiadan hareketle çalışma, Dava’nın söz konusu imkânsızlığı yaratabilmesini mümkün kılan iki temel unsurun bulunduğunu ileri sürmektedir. Bunlardan ilki, roman boyunca gelişen tüm olayların, bir olağanüstü hâl ya da savaş durumu içinde değil, bütünüyle bir barış durumu içinde cereyan etmesidir. İkinci unsur ise, hukukun ideolojik boyutunun merkeze alınmasıdır; ancak bu boyut, hukukun yalnızca maskeleyici ya da gizemlileştirici işlevleriyle sınırlı değildir. Aksine, hukukun toplumsal gerçekliği (yeniden) yapılaştıran ve yeniden üreten etkisi bu çalışmanın odağında yer almaktadır.
