Concepts of The Rule of Law and Rechtsstaat According to Franz L. Neumann and The Effect of Max Weber

Abstract

The relationship between modern law and the modern state is important for the criticism of the liberal state. The aim of this study is to reveal how the jurist and political theorist Franz Leopold Neumann, one of the first representatives of the Frankfurt School, handled the concepts of the rule of law and Rechtsstaat. Identifying the historical origins and differences between these two concepts, which are increasingly used synonymously today, and revealing the changes in meaning that each concept has undergone within itself is crucial. The study will apply the Cambridge School's method of historiography of thought. Another aim of the study in this context is to explore how the views of Max Weber, one of the most important thinkers of the time, influenced Neumann. Indeed, this influence is central to Neumann's analysis of the relationship between the liberal state and the law.

Franz L. Neumann’a Göre Hukukun Üstünlüğü ve Hukuk Devleti Kavramları ve Max Weber’in Etkisi

Abstract

Modern hukuk ve modern devlet arasındaki ilişki liberal devlet eleştirileri açısından önemlidir. Bu çalışmanın amacı, Frankfurt Okulu’nun ilk dönem temsilcilerinden hukukçu ve siyaset teorisyeni Franz Leopold Neumann’ın hukukun üstünlüğü (the rule of law) ve hukuk devleti (Rechtsstaat) kavramlarını ne şekilde ele aldığını ortaya koymaktır. Günümüzde giderek eşanlamlı kullanımı yaygınlaşan bu iki kavramın tarihsel kökenlerini ve aralarındaki farkları tespit etmek hatta her bir kavramın kendi içinde geçirdiği anlam değişikliklerini ortaya koymak önem arz etmektedir. Çalışmada, Cambridge Okulu’nun düşünce tarihçiliği yöntemi uygulanacaktır. Bu kapsamda çalışmanın bir diğer amacı da dönemin önemli düşünürlerinden biri olan Max Weber’in görüşlerinin Neumann’ı nasıl etkilediğini irdelemek olacaktır. Nitekim bu etki Neumann’ın liberal devlet ve hukuk ilişkisi analizinde merkezi bir konuma sahiptir.
