Examination of Short-Term Rental Regulations In Comparative Law With The Regulations Entered Into Force In Turkish Law

Abstract

With the increasing trend towards the concept of sharing economy; it is observed that the number of short-term, daily and tourism rentals has started to increase. This increase has led to the spread of platforms such as AirBnb, also with the effect of developing technology, and these activities have reached the point where they have almost become a sub-branch of the tourism sector. The legislator has aimed to regulate this growing sector. It is seen that this area has been regulated in many countries in comparative law. Law No. 7464, which entered into force in our country, and the regulation published based on it; show many similarities with the regulations in Germany, England, France, Austria, Belgium, Portugal, Netherlands, Spain, Italy and the United States of America. For example, the regulations put into effect regarding the furnishing, decoration, security measures and the comfort and correct information of the guests in the houses to be rented show great similarities with the examples in comparative law. On the other hand, the prohibition of practices such as renting out rooms in a house contradicts the increasing trend of sharing economy all over the world. In addition, the professional conduct of short-term rentals within the scope of a commercial activity has been subject to much easier procedures than the subjecting of a short-term rental relationship to a house used by an individual.

Mukayeseli Hukukta Yer Alan Kısa Süreli Kiralama Düzenlemelerinin Türk Hukukunda Yürürlüğe Giren Mevzuatla Birlikte Değerlendirilmesi

Abstract

Paylaşım ekonomisi kavramına yönelik eğilimin artmasıyla birlikte; kısa süreli, günübirlik ve turizm amaçlı kiralamaların sayıca artmaya başladığı gözlemlenmektedir. Bu yöndeki artış, gelişen teknolojinin de etkisiyle AirBnb gibi platformların yaygınlaşmasına yol açmış ve bu faaliyetler adeta turizm sektörünün bir alt kolunu teşkil edecek noktaya kadar gelmiştir. Kanun koyucu büyüyen bu sektörü düzenleme altına alma amacı gütmüştür. Mukayeseli hukukta pek çok ülkede de söz konusu bu alanın düzenleme altına alındığı görülmektedir. Ülkemizde yürürlüğe giren 7464 sayılı kanun ve buna dayanılarak yayınlanan yönetmelik; Almanya, İngiltere, Fransa, Avusturya, Belçika, Portekiz, Hollanda, İspanya, İtalya ve Amerika Birleşik Devletleri’nde yer alan düzenlemelerle pek çok noktada benzerlikler göstermektedir. Örneğin kiralama yapılacak olan konutlarda tefrişat, dekorasyon, güvenlik önlemleri ve misafirlerin konforu ile doğru bilgilendirilmesine yönelik yürürlüğe giren düzenlemeler, mukayeseli hukuktaki örneklerle oldukça büyük benzerlikler göstermektedir. Buna karşın bir evin odalarının kiralanması gibi uygulamaların yasaklanması, tüm dünyada artan paylaşım ekonomisi eğilimine aykırı düşmektedir. Ayrıca kısa süreli kiralama işinin ticari bir faaliyet kapsamında profesyonel şekilde yapılması, bireysel olarak kendi kullandığı bir evin kısa süreli kiralama ilişkisine konu edilmesi karşısında çok daha kolay prosedürlere tabi kılınmıştır.
