Benefiting from collective agreement by paying solidarity due without being a member of a trade union parties to a collective agreement is an important problem in labour law. The main source of this problem is the crossroad of collective union freedom and negative union freedom. The regulation in the 4th paragraph of Article 39 of Act No. 6356 named “Benefiting from Collective Agreement”; “…benefiting from the collective agreement by paying solidarity dues is valid from the date of request. Requests made before the signature date shall take effect as of the signature date.” while it reads as follows, the provision “Requests before the signature date shall take effect as of the signature date.” in this article was annulled by the decision of the Constitutional Court dated 30.12.2020, numbered 2020/57, 2020/83. In this study, after briefly addressing the scope of collective bargaining agreements and the utilization of such agreements, the focus will turn to benefiting from collective bargaining agreements by paying a solidarity contribution, the Constitutional Court's decision to annul the last sentence of Article 39/4 of Law No. 6356 regarding benefiting through solidarity contribution, and some potential issues that may arise in practice concerning this matter.
Toplu iş sözleşmesine taraf olan işçi sendikasının üyesi olmaksızın dayanışma aidatı ödeyerek yararlanma, iş hukukunda önemli bir sorundur. Bu sorunun ana kaynağı ise, kolektif sendika özgürlüğü ile negatif sendika özgürlüğünün kesişmesidir. 6356 sayılı Kanunu’nun “Toplu İş Sözleşmesinden Yararlanma” başlıklı madde 39. fıkra 4’teki düzenleme; “…Dayanışma aidatı ödemek suretiyle toplu iş sözleşmesinden yararlanma, talep tarihinden geçerlidir. İmza tarihinden önceki talepler imza tarihi itibarıyla hüküm doğurur.” şeklinde iken bu hükümdeki “...İmza tarihinden önceki talepler imza tarihi itibarıyla hüküm doğurur.” cümlesi Anayasa Mahkemesi’nin 30.12.2020 tarih, 2020/57 E., 2020/83 K. Sayılı kararıyla iptal edilmiştir. Bu çalışmada Anayasa Mahkemesi’nin iptal kararı sonrasında dayanışma aidatına ilişkin uygulamada ortaya çıkan birtakım sorunlar incelenecektir.
