ONLIGATION OF PRIVATE WATER SERVICE PROVIDER FOR RIGHT TO WATER

Abstract

There are interventions arising from different factors in the access of individuals to water, which is an indispensable part of life and a precondition for the provision of many rights. One of these factors is private water service suppliers who provide water, natural resource, to individuals and groups by seeking profit. Although these private enterprises, which take over water service from the public forces through various methods, interferes with individuals' access to water by their activities on water resources, bottling of water, etc., action has been taken in both regional and international context and water has been recognized as a human right. Nevertheless, certain soft law rules have been adopted that may lead to the accountability of private water service suppliers as such companies are continuing their activities with commercial concerns, causing negative human rights impacts. In this context, this paper aims to demonstrate the interventions of private water service suppliers to the right to water, obligations arising from these interventions and their sufficiency.

Özel Su Hizmeti Sağlayıcılarının Su Hakkına Yönelik Yükümlülükleri

Abstract

Bireylerin, yaşamın vazgeçilmezi ve pek çok hakkın sağlanmasının ön şartı olan suya erişimine farklı faktörlerden kaynaklanan müdahaleler söz konusudur. Bu faktörlerden birisi, bireylere ve gruplara doğal kaynak olan suyu kar amacı güderek sağlayan özel su hizmeti sağlayıcılarıdır. Çeşitli usullerle kamudan su hizmetini devralan bu özel işletmeler, bireylerin suya erişimine; su kaynaklarına, suyun şişelenmesine vb. yönelik faaliyetleri ile müdahale etmektedir. Özel işletmelerin müdahaleci faaliyetleri karşısında, suya erişim hem bölgesel hem de uluslararası belgelerde temel insan haklarından biri olarak kabul edilmiştir. Özel su hizmeti sağlayıcılarının, ticari kaygılar güderek olumsuz insan hakları etkilerine yol açan faaliyetlerine devam etmesi nedeniyle söz konusu işletmelerin sorumlu tutulmasına yol açabilecek bazı yumuşak hukuk kuralları kabul edilmiştir. Bu bağlamda makalede, özel su hizmeti sağlayıcılarının su hakkına müdahalelerinin, bu müdahalelerden doğacak yükümlülüklerin ve yükümlülüklerin yeterli olup olmadığının ortaya konulması amaçlanmıştır.
