Afrika İnsan ve Halkların Şartı ve Afrika İnsan ve Halkların Hakları Komisyonu Kararları Açısından Self Determinasyon Hakkı

Abstract

Kökleri eskiye dayansa da, Birleşmiş Milletler’in kurulmasıyla birlikte bir norm haline gelmeye başlayan self determinasyon hakkının anlamı ve kapsa-mı, uluslararası hukuk doktrininde yıllardır tartışılmaktadır. Self determinas-yon hakkının uluslararası insan hakları hukukunda somut bir şikayet konusu olması noktasında şüpheler bulunmaktadır. Bu bağlamda 1981 yılında imza-lanan Afrika İnsan ve Halkların Hakları Şartı’nın yürürlüğe girmesiyle, self determinasyon hakkının anlamının ve kapsamının anlaşılmasında, bölgesel bazda da olsa bir fırsat doğmuştur. Afrika İnsan ve Halkların Hakları Komis-yonu’nun önüne gelen self determinasyon hakkının ihlalini de içeren şikayet-lerde, Komisyonun verdiği kararlar bu hakkın içeriğinin anlaşılması açısından önem taşımakta ve self determinasyon hakkı ile ülkesel bütünlük ilkesi arasın-daki gerilimin anlaşılmasına da yardım etmektedir.

The Right to Self-Determination with the Regards to the African Charter on Human and Peoples' Rights and the Decisions by the African Commission on Human and Peoples' Rights

Abstract

Although its roots go back to the past, the meaning and scope of the right to self-determination, which became a norm with the establishment of the United Nations, has been discussed in the international legal doctrine for years. There are doubts that the possibility of a concrete complaint about the right to self-determination in international human rights law. With the entry into force of the African Charter of Human and Peoples' Rights, signed in 1981, an opportunity has arisen in understanding the meaning and scope of the right to self-determination, albeit on a regional basis. In bringing the complaints to the attention the African Commission on Human and Peoples' Rights, including the violation of the right to self-determination, the decisions reached by the Commission are important in understanding the content of this right and helps to understand the tension between the right and the principle of territo-rial integrity.
