Abstract

Osmanlı seçkinleri, Batı karşısındaki gerilemenin nedenlerini devlet örgütünün özelliklerineatfederek devlet aygıtının yapı ve işleyişinde yenilikler yapma yolunu tuttular. Batıgelişmişliği başlangıçta birtakım teknolojilerin aktarımı ile gerçekleştirilmeye çalışılmışsa dazamanla yenileşme çabalarının ilkeler ve örgütleri kapsamasının gerekliliği anlaşılmıştır.Bu çerçevede ilkin kanun ve usuller aktarılmış, sonra bu kanun ve usullerin uygulanmalarınısağlayacak örgütler kurulmuştur. Batının sosyo-politik anlayışı temelinde oluşturulan buyapılanma, geleneksel Osmanlı toplumsal yapı ve örgütlerinde köklü değişimlerin ortayaçıkmasını sağlamış, bu değişim süreci, geleneksel yönetim ve yargı kurumlarının işlerlikalanlarının sınırlanmasına neden olmuştur. Katılımcı bir anlayışın gelişmesi, Osmanlı yönetimininmonarşiden parlamenter sisteme dönüşüm sürecine olumlu katkılar sağlamıştır.Bu çalışmada Osmanlı siyasal ve hukuksal modernleşmesinin örgütsel yapısı ve dinamikleriincelenmeye çalışılmıştır.

Modernization Of The Political And Legal Structure From The Tanzimat To The Republic

Abstract

Ottoman elites saw the causes of decay in the characters of state organization and attempted to make reform in the structure and functioning of the state apparatus. Although, in the beginning the western developments were adapted through transferring some of the technologies, in time was understood that the attempts at reform should contain the principles and organizations. In this framework, primarily laws and methods were transferred, and then organizations were established in order to apply these laws and methods. This restructuring based on the socio-political conceptions of the West led the emergence of fundamental change in the traditional Ottoman structure and organization. This process of change resulted in the limitation of the functions of traditional administrative and judiciary institutions. The development of a participatory approach positively contributed to the process of transformation from monarchy to parliamentary system. This study makes a consideration of organizational structure and dynamics of the Ottoman political and legal modernization
