HOBBES, LOCKE VE ROUSSEAU’DA “DOĞA DURUMU” DÜŞÜNCESİ

Öz

Eskiçağdaki physis-nomos karşıtlığı, 17. ve 18. yüzyıl felsefelerinde, doğa durumutoplum durumu (ya da doğal hukuk-pozitif hukuk) karşıtlığı biçiminde yeniden tartışılmaya başlanır. Hobbes, Locke ve Rousseau söz konusu olduğunda bu karşıtlık toplum sözleşmesi bağlamında da ele alınır. Gerek devletin varlık nedeninin ne olduğu, insanların niçin bir otoriteye boyun eğmeleri gerektiği gibi sorular yanıtlanırken, gerekse doğal hakların neler olduğu, doğal hukukun kaynağının ne olduğu tartışılırken filozofların doğa durumu (ya da doğal durum) diye bir şey tasarladıklarını görüyoruz. Hem politika felsefesinde hem de ahlak felsefesinde sözü edilen “doğa durumu”na, toplum ya da uygarlık öncesi bir durumu anlatmak için başvurulmaktadır. Bu yazıda, “doğa yasası”, “doğal hukuk” düşüncesinin temelinde yer alan “doğa durumu” tasarımı irdelenecektir. Ama bu irdeleme, “doğa durumu” denilince ilk akla gelen filozoflardan, düşünürlerden Hobbes, Locke ve Rousseau’nun görüşleriyle sınırlandırılacaktır. Bu filozoflarda ‘devletin varlık nedeni’nin ne olduğu, devletin niçin varolduğu ortaya konulurken, onların “doğa durumu”, “doğa yasası”, “sözleşme” ve “insan doğası” hakkındaki görüşleri de kısaca karşılaştırılacaktır.

CONCEPT OF “STATE OF NATURE” ON HOBBES, LOCKE AND ROUSSEAU

Abstract

The physis-nomos opposition set in the Ancient Philosophy had been reconsidered within the scope of the opposition between the state of nature and the state of society (or between natural law and positive law) in the 17th and 18th centuries, viz., the modern philosophy. Regarding Hobbes, Locke and Rousseau, the opposition is taken up within the context of social contract. The disputes on the teleological cause of state and the necessity to obey an authority on one hand, and the essence of rights of nature and the origin of law of nature on the other, we see that philosophers have put forward an idea so-called the state of nature (or natural state). Both in political philosophy and in moral philosophy, the state of nature mentioned is taken as a standpoint to refer to pre-civilization or pre-society. This study is aimed as an inquiry on the idea of the state of nature which sets the background of some thoughts like “law of nature” and “rights of nature”. However the scope of this study will not exceed the views of Hobbes, Locke and Rousseau, whose names are the first to commemorate when “the state of nature” is the case. What is more, this essay contains a concise discussion, too, on what the teleological cause of the state could be, why the state exists within the thoughts of Hobbes, Locke and Rousseau, their views about “the state of nature”, “law of nature”, “social contract” and “human nature”
