In Article 44 of the Execution and Bankruptcy Law, the obligations of the merchant who left the trade, in Article 337/a, as a sanction for breach of these obligations imprisonment are regulated. This study aims to evaluate and explain these regulations in the light of judicial decisions. Within this framework, primarily the obligations of the trader who left the trade, then the prison sentence foreseen as the sanction of breach of these obligations and the burden of proof regulated in this context are explained.

İcra ve İflas Kanunu’nun 44. maddesinde ticareti terk eden tacirin yükümlülükleri ve 337/a maddesinde ise bu yükümlülüklere aykırılığın yaptırımı olarak hapis cezası düzenlenmiştir. Bu makale ile söz konusu düzenlemelerin yargı kararları ışığında değerlendirilmesi ve açıklanması amaçlanmaktadır. Bu çerçevede ilk olarak ticareti terk eden tacirin yükümlülükleri, ardından da bu yükümlülüklere aykırılığın yaptırımı olarak öngörülen hapis cezası ve bu kapsamda düzenlenen ispat yükü açıklanacaktır.
