REFLECTIONS OF THE CONCEPTS OF CREATIVITY, ORIGINALITY AND CHARACTERISTIC ON THE GENERATIVE AUTONOMOUS AI SYSTEMS WITH AN ANALYSIS OF COPYRIGHT PERSPECTIVE

Abstract

Artificial Intelligence (AI) Systems are increasingly prevalent with technological advancements, emerging as the focus of scientific studies. The question of whether products generated by a subtype of these AI systems, known as Generative Autonomous Artificial Intelligence (GAI) meet the criteria for being considered works is a key aspect in ongoing discussions. Our research aimed to emphasize necessity of reconsideration from an international and multidimensional perspective when evaluating whether the products/outputs resulting from machine learning processes, where human intervention is minimized and conducted with datasets containing existing works, possess the creativity, originality or characteristic/ distinctiveness features necessary to be classified as works. With this viewpoint; we tried to determine the distinction between artificial intelligence and human creativity by exploring what aspects cannot be transferred to artificial (generic/substitute) intelligence systems from human who have revealed creativity in creating works throughout human existence.

YARATICILIK, ORİJİNALLİK VE HUSUSİYET KAVRAMLARININ ÜRETKEN OTONOM YAPAY ZEKÂ SİSTEMLERİNE YANSIMALARI VE FİKRİ HAKLAR BOYUTUYLA DEĞERLENDİRİLMESİ

Abstract

Yapay Zekâ sistemleri teknolojik ilerlemelerle birlikte yaygınlaşmakta ve bilimsel araştırmaların odak noktası haline gelmektedir. Bu sistemlerin bir alt türü olan Üretken Otonom Yapay Zekâ Sistemleri tarafından üretilen ürünlerin eser niteliği taşıyıp taşımadığı konusu ise mevcut tartışma ve araştırmalarda merkezi bir yer tutmaktadır. Araştırmamızda; insan müdahalesinin asgari seviyeye indirgendiği ve aslında hâlihazırda var olan eserlerin yer aldığı veri setleriyle sürdürülen makine öğrenmesi süreçleri sonunda ortaya konan ürün veya çıktıların eser niteliğine ulaşmak için gerekli yaratıcılık/orijinallik veya hususiyeti taşıyıp taşımadıkları hususunun tespitinde uluslararası ve çok yönlü bir bakış açısıyla yeniden düşünmemiz gerektiğini vurgulamaya çalıştık. Bu bakış açısıyla; yaratıcılığını ortaya koyarak insanoğlunun varoluşundan bu yana eser meydana getiren gerçek insandan, yapay (jenerik/ikame) zeka sistemlerine aktarılamayacak olanın ne olduğunu anlamaya çalışarak yapay zeka ve insan yaratıcılığı arasındaki ayrımı belirlemeye çalıştık.
