Adaptation of the administrative structure of the General Directorate of Forestry and some forestry legislation to the Turkish emissions trading system

Abstract

This study was prepared for the purpose of updating the administrative structure of the General Directorate of Forestry and Turkey's forestry legislation on emission trading system. Studies devoted to the establishment of emission trading system after 2015 are still ongoing in Turkey. Besides, certificated carbon credits can be achieved from forestry projects prepared for carbon markets. Thus, forest ecosystems composing the unique sink sector, occupy an important place according to Turkey's national greenhouse gas inventory. In order to be a member of the emission trading system after 2015, General Directorate of Forestry needs to make some changes in its administrative structure and legislation. According to the results of the study, the Division for Climate Change was proposed to deal with climate change issues effectively. Also, it was to make amendments in Article 169 of 1982 Constitution, in Forestry Law No. 6831 and in Law No. 3234 about the Adoption of the Decree Law on the Organization and Obligations of the General Directorate of Forestry Upon Being Amended.

Abstract

Bu çalışma, Orman Genel Müdürlüğü idari yapısının ve Türkiye ormancılık mevzuatının emisyon ticaret sistemine yönelik güncellenmesi amacıyla hazırlanmıştır. Türkiye'de, 2015 yılı sonrasında emisyon ticaret sisteminin kurulmasına yönelik çalışmalar devam etmektedir. Bunun yanında, karbon piyasalarına yönelik hazırlanan ormancılık projelerinden sertifikalı karbon kredileri elde edilebilmektedir. Türkiye'nin ulusal sera gazı envanterine göre tek yutak alanlarını oluşturan orman ekosistemleri bu nedenle önemli bir yere sahiptir. Orman Genel Müdürlüğü'nün ileriki dönemde karbon piyasalarına girebilmesi için idari yapısında ve mevzuatında bazı değişiklikler yapması gerekmektedir. Çalışma sonucuna göre, idari olarak İklim Değişikliği Şube Müdürlüğü'nün kurulması ve mevzuat açısından da 1982 Anayasası'nın 169. maddesinde, 6831 Sayılı Orman Kanunu'nda ve 3234 Sayılı Orman Genel Müdürlüğü Teşkilat ve Görevleri Hakkında Kanun Hükmünde Kararnamenin Değiştirilerek Kabulü Hakkında Kanun'da değişikliklerin yapılması önerilmiştir.
