The Use of Biological Materials Taken From Subjects Who Participate in Clinical Trials
Abstract
Volunteers should participate in clinical research by signing the informed consent form in accordance with the relevant legislation which must be accepted under the appropriate disclosure requirements. Since the “Good Clinical Practice Guidelines” states that “Voluntary or legal representative must be informed about all aspects of the research”, informed consent form should include not only the purpose and design of the research, but also, the scope of diagnostic and therapeutic methods as well. Therefore, volunteers should be informed about the use of the data that would be obtained by the examination of biological materials which were taken from them and from the evaluation of these samples. The samples and the data shall only be used under volunteer's clear consent which is subject to accurate and clear disclosure requirements. However, sometimes in the informed consent forms, one can face with the circumstances that allow the use and share of the samples as well as the data, in contrary to the purpose of taking them. This improper use and consent proceedings cause the violation of the volunteer's right and the law. Therefore, the volunteer's rights should be respected in line with the ethical principles and the legal framework by knowing and applying the due regulations.
