İdari Usul Kanunu (ve Bilgi Edinme Hakkı) Gereksinimi Üzerine

Driving citizens out of a passive stance by empowering them against the administration through rights to information and administrative procedures acts constitute the main pillars as a principle relating to basic constitutional rights and liberties. It is only thus attainable to reach at a democratic governance de lege feranda, and only by this way can illusions over democracy be prevented. Nonetheless, administrative procedure and right to information necessitates foremost a notion-based analysis and perceptions that should be rightly established. The study aims to lay down an approach with such notion. In this context specifically emphasising on economic rights and freedoms are beacuse of the understanding that in our country major infringements of main constitutional rights and liberties happen to emerge in this field, and more importantly that the vulnerable societal infrastructure thus created paves the way to the other suprastructural problems.

Yönetilenlerin idareye karşı bilgi edinme hakkı ve idari usul yasası çerçevesinde edilgen konumdan çıkarılıp söz sahibi kılınmaları, anayasal hak ve özgürlüklere ilişkin temel bir ilke sorunudur. Demokrasinin olması gereken uygulamasına ancak böylelikle kavuşulabilir ve demokrasi yanıltmacalarına bu yolla engel olunabilir. Ne var ki, idari usul ile bilgi edinme hakkı öncelikle nosyon temelinde doğru bir kurguyu ve algıyı gerektirir. Çalışma, işte bu nosyon odaklı yaklaşımı ortaya koymayı amaçlamaktadır. Bu yönde özellikle ekonomik özgürlüklerin ele alınması, ülkemizde bu yoldaki temel anayasal hak ve özgürlük ihlallerinin sözkonusu alanda belirdiğine ve daha da önemlisi, bundan dolayı oluşan sağlıksız toplumsal altyapının diğer üstyapısal sorunları doğurduğuna yönelik düşünceye dayanıyor.
