6098 Sayılı Türk Borçlar Kanunu Çerçevesinde İlaç Üreticisinin Hukuki Sorumluluğu

There is neither a code regarding the liability of producers nor a special medicine code in Turkish Law. Besides, The Code of Obligations no 6098 entered into force in 1 July 2012. In this respect, legal liability of medicine producers is basically dealt in accordance with The Code of Obligations no 6098 in this study. Firstly, legal principles for the liability of medicine producers are analyzed in the scope of the study. After that, the individuals to be liable for the defect in medicines are explained. Then, the conditions of aforementioned liability are described. Finally, the party to be folded the burden of proof and jointly liable individuals are described together with conditions for the statute of limitations. And it is depicted whether the agreement of nonliability is valid.

Türk Hukukunda üreticinin sorumluluğuna dair bir kanun bulunmadığı gibi, özel bir ilâç kanunu da mevcut değildir. Diğer taraftan, 6098 sayılı Borçlar Kanunu ise, 1 Temmuz 2012 tarihinde yürürlüğe girmiştir. Bu itibarla, söz konusu çalış- mada ilâç üreticisinin hukukî sorumluluğu, esasen 6098 sayılı Borçlar Kanunu çerçevesinde ele alınmıştır. Çalışma kapsamında öncelikle ilâç üreticisinin sorumluluğunun hukukî esasları incelenmiştir. Daha sonra, ilâçtaki hatadan kaynaklanan zararlardan kimlerin sorumlu tutulması gerektiğinin izahı yapılmıştır. Çalışmanın devamında, söz konusu sorumluluğun şartları tespit edilmiştir. Nihayet, ispat yüküne hangi tarafın katlanması gerektiği, sorumsuzluk anlaşmasının geçerli olup olmadığı, kurtuluş isbatı ile sorumluluğun azaltılması veya kaldırılmasının mümkün olup olmadığı, kimlerin müteselsilen sorumlu tutulması gerektiği ve zamanaşımı hususlarında tespitlerde bulunulmuştur.
