23 Temmuz 2008 Tarihli Anayasa Reformu Işığında Fransa'daki Yarı Başkanlık Sistemi

Like all governmental systems, the semi-presidential system takes shape according to the political climate of the state in which it is applied. One of the states that put the system in question into practice was France. In this context, we demonstrate how the semi-presidentiel system emerged by examining contemporary French constitutional history. Additionally, we will explicate the positive and negative charecteristics of the semi-presidentiel system by analysing the dualist executive organ which is comprised of a president of the republic who is elected directly by the public, as well as a legislative organ that consists of the national assembly and the senate.

Tüm hükümet sistemleri gibi yarı başkanlık sistemi de uygulandığı devletin siyasi iklimine göre şekillenmektedir. Söz konusu sistemi uygulayan devletlerden biri de Fransa’dır. Bu kapsamda, yakın dönem Fransız anayasa tarihine dikkat edilerek yarı başkanlık sisteminin nasıl ortaya çıktığı belirtilecektir. Ayrıca, doğrudan halk tarafından seçilen bir cumhurbaşkanının varlık gösterdiği ikili yürütme organı, keza Millet Meclisi ve Senatodan oluşan yasama organı da incelenerek yarı başkanlık sisteminin olumlu ve olumsuz özellikleri ortaya konulacaktır
