İş Hukukunda Belirsiz Alacak Davası ve Kısmi Dava

The types of lawsuits which were set out under between Article 105 and Article 113 of Civil Procedure Law numbered 6100 which entered into force on the date of October 1st, 2011 brought new rules which were not regulated in the prior Civil Procedure Law. With the new regulation, the discussion in the doctrine as to which type of lawsuit can be commenced against the labour’s receivables has shown that the discussion with the different judge rulings rendered for this subject  will be in practice. With this study, the subject in dispute has been researched in theory and in practice by giving the opinions from the doctrine, the basic information and the judge rulings in relation to this subject

01. 10. 2011 tarihinde yürürlüğe giren 6100 sayılı Hukuk Muhakemeleri Kanunu’nun 105 ila 113. maddeleri arasında düzenlenen dava türleri önceki usul yasamızda yer almayan bazı yenilikler getirmiştir. Yapılan yeni düzenleme ile, öğretide işçilik alacaklarının hangi dava türü aracılığıyla istenebileceği konusundaki tartışma, konuyla ilgili farklı yönde verilen yargı kararları ile tartışmanın uygulama alanında olacağını da göstermiştir. Yapılan çalışmada, öğretiden görüşlerle birlikte konuyla ilgili temel bilgilere ve yargı kararlarına yer verilerek, tartışmalı konu, teorik açıdan ve uygulama açısından incelenmiştir.
