THE KOSOVO SPECIALIST CHAMBERS IN TERMS OF INTERNATIONAL LAW

Öz

Several international mechanisms have been set up to prosecute humanitarian
law violations during the independence process of Kosovo. First, hybrid
mechanisms called “Regulation 64 Panels” were established under the UNMIK
administration, and after Kosovo’s declaration of independence, these proceedings
were continued through the EULEX mission. On the other hand,
the Kosovo Liberation Army has been alleged various charges such as human
organ trafficking. The prosecution of these allegations has come up especially
with the influence of the EU and the United States. The “Kosovo Specialist
Chambers” has been established to prosecute those allegations. In this article,
first, the UNMIK and EULEX missions will be examined. Second, the structure
and the character of the Kosovo Specialist Chambers, which can be regarded as
a new hybrid court, will be compared with other international hybrid courts.

Uluslararası Hukuk Açısından Kosova Uzman Daireleri

Öz

Bağımsızlık sürecinde Kosova’da yaşanan insancıl hukuk ihlallerinin yargılanması
amacıyla çeşitli mekanizmalar kurulmuştur. Öncelikle UNMIK yönetimi
altında “Tüzük 64 Panelleri” adı verilen melez mekanizmalar oluşturulmuş,
Kosova’nın bağımsızlık ilanından sonra ise bu yargılamalar, EULEX misyonu
aracılığıyla sürdürülmeye çalışılmıştır. Diğer taraftan, Kosova Kurtuluş Ordusuna
organ kaçakçılığı gibi çeşitli suçlamalar yöneltilmiş ve AB ve ABD’nin
baskısıyla bu iddiaların yargılanması gündeme gelmiştir. Bunun üzerine söz
konusu eylemleri yargılamak amacıyla “Kosova Uzman Daireleri” kurulmuştur.
Makalede UNMIK ve EULEX misyonu çerçevesindeki mekanizmalara
değinildikten sonra, yeni bir melez mahkeme olarak kabul edilebilecek olan
Kosova Uzman Dairelerinin kuruluşu, yapısı ve niteliği, yeri geldiğinde diğer
melez mahkemelerle karşılaştırılarak ele alınacaktır.
