5941 Sayılı Çek Kanunu'nda Düzenlenen İdari ve Cezai Yaptırımlar

In accordance with the critics pointing out that penal provisions are incompatible with the articles numbered 13, 38/8 and 48/1 of the Constitution, that it is totally insignificant to give judicial fine convertible to imprisonment to those who do not pay their debts, the penal sanctions applied in case of dishonored checks have been abrogated together with the Law numbered 6273 which amended the Check Law numbered 5941. Instead, the interdictions to “make out a check” and “open a check account” have been introduced as in the EU countries. However, this situation has led to the protection of the rights of the debtor more than the creditor, although involuntarily. Since the administrative sanctions which might be enough for societies where the principle pacta sunt servanda keeps its importance as a moral value are not conform to the Turkish commercial life where the moral concerning to undertake liabilities has been outraged, those who get into the habit of not paying their debts in Turkey have become immune, almost as the sacred cow of Indians. In this regard, the non-payment of the check is not only a legal problem, but at the same time a sociological problem

5941 sayılı Çek Kanunu’nda 6273 sayılı Kanunla yapılan değişiklikle birlikte, cezai hükümlerin Anayasa m. 13, m. 38/8 ve m. 48/1’e aykırı olduğu, borcunu ödemeyene hapis cezasına dönüşen adli para cezası vermenin hiçbir anlamı olmadığı yönündeki eleştiriler doğrultusunda, çekin karşılığının çıkmaması halinde uygulanan cezai yaptırımlar kaldırılmıştır. Bunun yerine AB ülkelerinde olduğu gibi idari yaptırım niteliğindeki “çek düzenleme” ve “çek hesabı açma” yasağı getirilmiştir. Fakat bu durum istemeden de olsa borçlunun haklarının alacaklıdan daha çok korunmasına yol açmıştır. Ahde vefanın bir ahlaki değer olarak önemini koruduğu toplumlar açısından yeterli olabilecek idari yaptırımlar, borcunu üstlenme ahlakı sarsılmış Türk ticari hayatına uymadığı için Türkiye’de borcunu ödememeyi alışkanlık haline getirenler adeta Hintlilerin kutsal ineği gibi dokunulmaz hale gelmiştir. Bu bakımdan çekin karşılığının ödenmemesi, sadece hukuki bir sorun değil, aynı zamanda sosyolojik bir sorundur
