Sürekli Borç İlişkilerinde Borçlunun Temerrüdü

If debtor renders the undertaken performence with a continous act over a time period, this will creates a continuous performance. The term “continuity” should be understood in the meaning that the act should be rendered within a long period having a de facto and de jure integrity, not in the meaning of uninterrupted and/ or non-stop performance. Identification of an act as a continous performance is important, with regard to adjust the provisions which will be applied in case of the invalidity of the contract and is important also for the termination of the contract. Default of contract including continious performance is regulated by Article 126 of Turkish Code of Obligation. In this article, the consequences of the default of contracts including continious performance, is studied according to the initiated and uninitiated fulfillment of the performance by referring to the different opinions of the doctrine,

Borçlu yüklendiği edimi zaman içinde sürekli bir eylemle yerine getiriyorsa bu sürekli edimi oluşturur. Buradaki süreklilikten anlaşılması gereken edimin zaman yönünden hiçbir kesintiye uğramadan, ara verilmeden ifası değil, davranışın fiili ve hukuki yönden bütünlük oluşturacak şekilde uzun bir zaman süresi içinde yerine getirilmesidir. Bir edimin sürekli edim olarak nitelenmesi, ilişkinin geçersizliğinde uygulanacak hükümler ile ilişkinin sona erdirilmesi açısından önemlidir. Sürekli borç ilişkisinde temerrüt hali TBK’nın 126. maddesinde düzenlenmiş olup, çalışmamızda edimin ifasına başlanmış ve başlanmamış olması durumuna göre temerrüdün sonuçları, bu konuda doktrinde yer alan farklı görüşlere de değinilerek incelenmiştir.
