Nükleer Korku Gölgesinde Uluslararası Barış ve Güvenlik

To date, there have been significant developments by the international community in order to prevent devastating nuclear effects in the life of humanity once again. Since 1945, prominent international institutions such as the United Nations, the International Atomic Energy Agency and individual states have devoted significant attention to the issue. Be that as it may, it is evident that the progress has been quite limited. In terms of eliminating general and complete nuclear threat, the rules and standards regulating the safety and security of existing nuclear weapons, materials or facilities have proved to be insufficient. The gist of this article is to examine the clear need to establish and mantain an effective universal legal order that provides for international cooporation and collaboration to prevent states, persons or any other organization from acquiring, harbouring, and using nuclear weapons.

Uluslararası toplum, 1945’den günümüze kadar, Birleşmiş Milletler, Uluslararası Atom Enerjisi Kurumu gibi önemli uluslararası kuruluşlar ve devletler nükleer tehdit konusuna önemli derecede dikkat çekmiş, yıkıcı nükleer etkileri bir daha yaşamamak için pek çok çabada bulunmuştur. Buna rağmen, nükleer gücün tehdit boyutunun azaltılması veya tamamen ortadan kaldırılması konusunda sınırlı bir ilerleme gerçekleştirilebilmiştir. Nükleer tehdit veya korkuyu tamamen ve genel olarak ortadan kaldırmak için yapılmış bulunulan düzenlemeler, mevcut nükleer silahların, malzemelerin veya ünitelerin güvenliği için konulmuş bulunulan kural ve standartlar yetersiz kalmıştır. Bu makalede, devletlerin, devlet-dışı kişi veya örgütlerin nükleer silah üretme, elde etme, bulundurma, kullanma veya kullanma tehdidinde bulunmasını önleme konusunda uluslararası işbirliği ve eşgüdümü sağlayan etkin ve işlevsel bir evrensel hukuk düzeninin tesisi ve korunması konusundaki açık ihtiyaç incelenmektedir
