Security Council Mandate Formation and Impartiality in the Cyprus Peacekeeping Mission

Öz

This article argues that United Nations peacekeeping should not be assessed only at the operational level, but also at the earlier stage of Security Council mandate formation. Existing legal scholarship has often focused on accountability, human rights, humanitarian law, and the practical effectiveness of peacekeeping operations. This article shifts attention to the legal and political construction of mandates themselves. Using the United Nations Peacekeeping Force in Cyprus and Security Council Resolution 186 of 1964 as a case study, it examines how mandate language can shape recognition, consent, and impartiality before peacekeepers act on the ground. The article argues that the reference to the “Government of Cyprus” in Resolution 186 did not adequately reflect the bicommunal constitutional crisis on the island and contributed to an operational framework in which the Turkish Cypriot position became less visible. The article does not claim that law can eliminate politics from Security Council decision-making. Rather, it argues that mandate drafting should be treated as a legal problem in its own right, requiring greater transparency, closer attention to affected communities, and stronger safeguards for the impartiality of peacekeeping operations.
