AFRİKA İNSAN VE HALKLARIN HAKLARI MAHKEMESİNİN İÇTİHATLARINDA İNSAN HAKLARININ KORUNMASINA YÖNELİK YAKLAŞIMLAR: ZORLUKLAR VE FIRSATLAR

Öz

Bu makale, Afrika İnsan ve Halkların Hakları Mahkemesi tarafından Afrika Şartı'ndaki eksiklikleri gidermek ve Afrika genelinde insan haklarının korunmasını geliştirmek için kullanılan yaklaşımları incelemektedir. Afrika Mahkemesi, çekişmeli yargı alanında 342 davayı ele aldı ve kuruluşundan bu yana 223'ü hakkında nihai kararlar verdi. Bu makale, Afrika Mahkemesi'nin çekişmeli yargı yetkisinde benimsediği yaklaşımları analiz etmeyi, Mahkeme'nin karşılaştığı zorlukları ve fırsatları belirlemeyi ve Afrika insan hakları sistemini geliştirmenin yollarını önermeyi amaçlamaktadır. Makale, Mahkeme'nin hem uygulanabilir hukukları seçerken hem de Afrika Şartı'nda tanınan hakların normatif içeriğini belirlerken insan haklarını korumak için kullandığı çeşitli yaklaşımlarına odaklanmaktadır. Bu nedenle makalenin kapsamı, içtihatlarını analiz etmekle sınırlıdır. Makale, nitel araştırma metodolojisini kullanmakta, belge ve içtihat analizi yoluyla veri toplamaktadır. Afrika Mahkemesi tarafından içtihatlarında kullanılan çeşitli yaklaşımları vurgulamaktadır. Yaklaşımlar, boşlukları ve ortaya çıkan zorlukları ele alarak Mahkeme'nin insan haklarını koruma yeteneğini geliştirirken, aynı zamanda potansiyel yasal belirsizlikler ve üye devletlerden gelen direnişleri de beraberinde getirmektedir. Makale, bu zorlukların üstesinden gelmek ve Afrika'da insan haklarının korunmasına yönelik çerçeveyi güçlendirmek için potansiyel stratejiler sunmaktadır.
