Türkiye Yerel Yönetim Sisteminde Geri Çağırma Hakkının Uygulanabilirliği Üzerine Bir Değerlendirme

The challenge of implementing direct democracy, driven by the increasing population, has resulted in representative democracy. In this system, the people's sovereignty is exercised through elected representatives within defined terms. Voters delegate the task of governing on their behalf to various persons or assemblies through general or local elections. However, it is hardly possible for the elected ones to be supervised by the ‘voters’ during their term of office, except in anticipation of the next election. An application called the right to recall (recall) has been developed in many countries of the world for voters who want to keep this consciousness alive by taking into account the relationship between the elected and the voters in the post-election process and reminding them of the responsibilities of the elected to the voters. In its basic form, the recall is a tool that enables voters to remove elected officials from office without waiting for their term of office to expire. Although the recall mechanism has been discussed in various periods in Turkey, it is not applicable due to the fact that it is not included in the current Constitution and laws. Doğrudan demokrasinin artan nüfus nedeniyle uygulanmasının zorlaşması, halka ait olan egemenliğin belirlenen süre içerisinde seçilen temsilciler aracılığıyla kullanıldığı temsili demokrasiyi ortaya çıkarmıştır. Seçmenler, genel veya yerel seçimler aracılığıyla kendileri adına yönetim görevini çeşitli kişi ya da meclislere devretmektedir. Ancak seçilmişlerin görev süreleri boyunca ‘seçmenler tarafından’ denetlenebilmesi, bir sonraki seçimin beklenmesinin dışında pek de mümkün değildir. Seçilmişler ile seçmenler arasındaki ilişkiyi seçimden sonraki süreçte dikkate almak, seçilmişlerin seçmenler karşısındaki sorumluluğunu hatırlatarak bu bilinci canlı tutmak, seçilmişlerin yönetiminden memnun olmayan ya da seçim sürecinde verdikleri vaatleri gerçekleştir(e)meyen seçilmişlere karşı memnuniyetsizliğini göstermek isteyen seçmenler için çok sayıda ülkede geri çağırma (recall) olarak isimlendirilen bir uygulama geliştirilmiştir. Geri çağırma basit haliyle; seçmenlerin göreve getirmiş oldukları seçilmişleri, görev sürelerinin dolmasını beklemeden görevden alınmalarını sağlayan bir araç olarak tanımlanmaktadır.Geri çağırma hakkı, Türkiye’de çeşitli dönemlerde tartışılmış olsa da mevcut Anayasa ve kanunlarda yer almamasından ötürü uygulanabilir değildir. Bu çalışmanın amacı; geri çağırma hakkının Türkiye’de yerel yönetimlerden başlanmak üzere uygulanabilirliğini tartışmak, Türkiye’nin sahip olduğu yerel yönetim sistemi üzerinden gerçekleşmesi muhtemel olumlu ve olumsuz sonuçlar üzerinden bir analizde bulunmaktır. Çalışma nitel yöntemle hazırlanmıştır.
