ÇOCUK CİNSEL İSTİSMAR MATERYALLERİNİN İNTERNET ORTAMINDA DOLAŞIMI: ONLYFANS ÖRNEĞİ

Öz

Artan internet kullanımı ve dijitalleşme çocuk cinsel istismar materyallerinin (ÇCİM) internet ortamında dolaşımını kolaylaştırarak çocukların cinsel istismardan korunmasını güçleştirmektedir. Özellikle bazı çevrimiçi video paylaşım platformları güvenli olmayan içeriğe daha fazla odaklanma eğilimindedir ve bu platformlar çoğu sosyal medya platformunda kullanıcı olmak için gereken minimum yaştan ve izin verilen içerik politikasından önemli ölçüde farklılaşır. Bu platformlardan biri olan OnlyFans, web sitesindeki cinsel içeriklerin çokluğu nedeniyle reşit olmayanlar için önemli bir risk oluşturmaktadır. Çalışma 2016’da Londra’da kurulan yetişkinlere özgü video paylaşım platformu olan OnlyFans’daki ÇCİM içeriklerini yeni teknolojiler ve yasal paradigma bakımından ele almaktadır. Site reşit olmayanlar tarafından oluşturulan ÇCİM içeriklerini engellemek üzere Site’ye ilk katılım süreçlerinde yüz tanıma ve doğrulama gibi yaş güvencesi teknolojilerinden büyük ölçüde yararlanmaktadır. Yeni veya bilinen ÇCİM’lerin tespiti, kaldırılması ve raporlanmasında da karma (hashing) teknoloji ÇCİM ile mücadelede önemli bir işlev üstlenmektedir. Platform ÇCİM’ye karşı kapsamlı politikalar ve teknolojik çözümler getirse de bilişim analizleri ve kapsamlı araştırmalar OnlyFans’tan sızan ÇCİM içeriklerinin başka platformlarda dolaştığını ve yaş ve kimlik doğrulama önlemlerinin yeterince etkin uygulanmadığını ortaya koymaktadır. Bu noktada Birleşik Krallık Çevrimiçi Güvenlik Yasa Tasarısı OnlyFans gibi platformların ÇCİM ile mücadeledeki yasal sorumluluğunu ağırlaştıracak yeni bir yasal çerçeve sunmakta ve ülkenin iletişim otoritesi OFCOM’a video paylaşım platformlarının düzenlenmesi ve denetlenmesi için yeni görevler yüklemektedir. Ampirik verilerden yararlanan bu araştırma, OnlyFans platformundaki ÇCİM içeriklerinin tespit edilmesinde belirli bir kullanıcının gerçek yaşının reşit olup olmadığının ve belirli bir içeriğin yasadışı ÇCİM içeriği olup olmadığının belirlenmesinde yararlanılan proaktif teknolojileri tartışmaya açarak mevcut literatüre katkı sağlamayı amaçlamaktadır.
