Batı Şeria Duvarı Ve Uluslararası Hukuk

Abstract

“West Bank Barrier”. This structure lacking a consensus even on its name has become a guarantee according to the Israelis to protect themselves from terrorist attacks while damaging to the right to the lives of Palestinian people. Its construction started in 2002 and %85 of the wall passes through the Palestinian territory. In 2005, the building was extended towards Jerusalem. When it comes to the year 2010, Israel has not put an end to the construction of the wall. The USA does not unconditionally support the wall and qualifies it as “problematic”. The United Nations and the International Court of Justice have also decided that the wall breaches international law and have concluded repeatedly that the wall is illegal. However, these decisions seem to be not really binding on Israel.

BATI ŞERİA DUVARI ve ULUSLARARASI HUKUK

Öz

“Batı Şeria Duvarı”. İsmi üzerinde dahi bir konsensüsün sağlanamadığı bu yapı, Filistin halkının yaşam haklarına zarar verirken, İsraillilere göre Filistinli terör eylemlerinden korunmak için bir güvence olmuştur. 2002 yılında inşasına başlanan duvarın %85‟lik kısmı Filistin topraklarından geçmektedir. 2005 yılında ise yapımı Kudüs‟e doğru uzatılmıştır. 2010 yılına gelindiğinde, İsrail bu inşaata hâlâ bir son vermiş değildir. ABD bu duvarı koşulsuz desteklememekte ve “sorunlu” olarak tanımlamaktadır. Birleşmiş Milletler ve Uluslararası Adalet Divanı karar mekanizmaları da bu duvarın uluslararası hukuka aykırı ve yasa dışı olduğuna dair birçok kez karar almıştır. Ancak bu kararların İsrail üzerinde bağlayıcı olduğu söylenemez.
