The principle of equality art 10 is an essential part of the Turkish Constitution. On the other hand prohibition of discrimination is provided by the European Convention on Human Rights in the art. 14 and the Protocol No. 12. In this article firstly the principle of equality is analyzed taking into consideration the constitutional provision and the case law of the Constitutional Court. Secondly the prohibition of discrimination provided by ECHR is examined relaying on the European Court of Human Rights cases. Finally the criterions used by the Turkish Constitutional Court are compared with those of the European Court of Human Rights
