Kuvvetler Ayrılığı Etrafındaki Yaklaşımların Tahlili

Abstract

Separation of powers is a state system which was devised in order to confine rulers’ power in the 17th century. According to this classification states are separated in three types such parliamentary, semi-presidential and presidential system. Separation of powers is a system proposal aiming to provide superiority of law. Because establishment of justice, respect for right and the election of administers are some of the rights of people. The most significant duty falls to people along with the existence of institutions. People is the biggest assurance of law participating in administration through election, inspecting administers and showing their reactions in accordance with law. Institutions such as election, party and assembly have evolved and been created in time. New institutions, systems, conceptions, principals and seek for solution will go on in parallel with humanity’s needs. So we should analyze current problems and make use of common heritage of humanity. Islamic culture is among this heritage. This experience mustn’t be ignored in raising a human type who gives priority to the interest of the community, who is educated and respectful for law and right, which is the most significant assurance of systems. It is an absolute must and need for living together to refer to Islamic morality rather than preference. Key Words

Öz

Kuvvetler ayrılığı XVII. Yüzyılda yönetenlerin iktidarını sınırlandırmak üzere geliştirilmiş bir devlet sistemidir. Bu tasnife a göre devletler; parlamenter, yarı başkanlık ve başkanlık sistemi diye üçe ayrılı. Kuvvetler ayrılığının uygulamalardaki örnekleri ihtiyaçlarla ortaya çıkmış hukukun üstünlüğünü sağlamaya matuf bir sistem önerisidir. Zira adaletin tesisi, hakka saygı, yönetenlerin seçimi temel ihtiyaçlardan bazılarıdır. Bunların sağlanmasında en önemli görev, halka düşmektedir. Halk, seçimle yönetime katılarak, yöneticileri denetleyerek, gerekirse hukuk ölçüleri içerisinde tepkilerini göstererek, hukukun en büyük teminatı olmaktadırlar. Seçim, parti, meclis vb. kurumlar zamanla oluşmuş, tekâmül etmiştir. İnsanlığın ihtiyaçlarına paralel yeni kurum, sistem, anlayış, prensip ve çözüm arayışı devam edecektir. Bu sebeple, mevcut problemleri yerinde tahlil etmek ve insanlığın ortak mirasından yararlanmak gerekir. İslam kültürü de bu miras içerisinde yer almaktadır. Sistemlerin en önemli teminatı olan eğitimli, hak ve hukuka saygılı, toplum menfaatlerini önceleyen bir insan modeli yetişmesinde bu tecrübe göz ardı edilmemelidir. Nüfusunun bir kesimi Müslüman olan ülkelerde daha sağlıklı ve birlikte yaşama ihtiyacı için İslam ahlakına atıf yapılması tercihten öte zarurettir.
